
If the new penal code is adopted as proposed, a voter who sells his vote would be punished more severely than the politician who buys it. Anyone who dares to sell a vote for material benefits or favors of any kind will be punished more severely than a party official.
The measure for them will be toughened to two years in prison, which would increase the maximum sentence from 5 to 7 years in prison for active corruption in elections.
"The solicitation or acceptance by a voter or his/her family members or close relatives of money, material goods, or other favors in any form contrary to the law, for oneself or others, with the intention of signing a signature for the nomination of a candidate in the elections, to vote in a certain way, to participate or not in the elections, or to engage in illegal activities in support of a candidate or political party, is punishable by imprisonment from two to seven years ," states Article 296, in the draft of the new Criminal Code.
While for the politician, or the person who seeks to buy votes, offer jobs or other favors, the punishment is surprisingly lighter, 3-6 years in prison.
"Offering or giving money, material goods, the promise of a job or other favors in any form contrary to the law, to a voter or other persons related to him, for the purpose of obtaining a signature for the nomination of a candidate in the elections, to vote in a certain way, to participate or not in the elections, or to engage in illegal activities in support of a candidate or political party, is punishable by imprisonment from three to six years ," states Article 297, in the draft of the new Criminal Code.
The current law provides that for active corruption in elections, the penalty is one to 5 years in prison.
The draft also provides for more prison sentences for those who ask for favors in exchange for votes. Unlike the current Criminal Code, which provides for a maximum sentence of up to 5 years in prison, for anyone who sells votes, the new draft increases the maximum sentence by 2 years.
Voting more than once will also place a greater legal burden on voters. The new draft stipulates that voting more than once in the same election, voting for other people, presenting false identification documents, or using documents belonging to other voters, is punishable by imprisonment of two to four years. The current law stipulates one to three years.
But although there is a stronger hand for corruption and double voting, there is a reduction in punishment in the case of photographing the vote. Under the current Code, photographing the vote costs the voter 3 years in prison, while the new draft provides for a fine or imprisonment from three months to two years.
