
The Supreme Court of Michigan has given the right to the former president, Donald Trump, to participate as a candidate in the upcoming presidential elections.
The ruling contradicts a Dec. 19 ruling by a Colorado Supreme Court ruling that Trump cannot run for president because of his role in the Jan. 6, 2021, attack on the US Capitol. The Colorado decision was the first time in history that Section 3 of the 14th Amendment has been used to disqualify a presidential candidate.
The Michigan and Colorado cases are among dozens of attempts by Democrats to keep Trump off the ballot next year. They all talk about the so-called 'insurrection clause' which prevents anyone from holding leadership positions if they have engaged in "insurrection or rebellion" against the Constitution.
Colorado's decision is likely to be appealed to the US Supreme Court, which has never ruled on the rarely used, Civil War-era provision.
Plaintiffs in Michigan could technically try again to disqualify Trump under Section 3 of the 14th Amendment in the general election, though it's likely that there will be a US Supreme Court ruling on the matter by then.
