
A foreign energy investment of around 10 million euros in the Malësia e Madhe area has been delayed for more than 8 years, due to bureaucratic obstacles, legal violations by the local government, and the indifference of Prime Minister Edi Rama, who is holding back the implementation of a final court decision.
We are talking about the companies "Malësia Solar 1, 2, 3", founded in 2012 by foreign Bulgarian investors, with administrators Dimitar Botev and Edmond Sterkaj, with the aim of building a photovoltaic power plant with a capacity of 7.5 - 8.6 MW near the Rec prison.
State permit and 30-year agreement
In 2012, foreign investors signed an agreement with the former Municipality of Shkreli, leasing 150,000 square meters of land for 30 years. The project envisaged the creation of around 120 new jobs and was considered a concrete contribution to the economic development of the area.
Following legal procedures, the Ministry of Energy granted the authorization for the construction of the power plant on January 14, 2015, while the National Territorial Council, with decisions no. 3, 4 and 5, dated 28.07.2016, approved the permits for the construction of the plant.
Violations by the Municipality of Malësia e Madhe: From 0.1% to 3%
In 2016, the investors requested the issuance of the construction permit and the payment of the corresponding fee. However, the Municipality of Malësia e Madhe, in violation of Law No. 9632, dated 30.10.2006 “On the local tax system”, requested the company to pay 3% of the investment value, instead of the legal rate of 0.1%.
This arbitrary action has blocked the project for years, forcing the companies to pursue legal action. On January 13, 2018, the investors paid the tax according to the legal rate (0.1%) and began the battle for the recognition of their right.
Final decisions ignored by the government
With decision no. 122, dated 21.02.2020 of the Administrative Court of First Instance and then with the final decision of October 7, 2021, the court ruled in favor of the investors, forcing public institutions to fulfill their legal obligations.
But despite the final decisions, the National Territorial Council, under the leadership of Prime Minister Edi Rama, has not yet signed the final act allowing the work to continue.
Propaganda and reality: Why is Rama silent?
This behavior contradicts the government's own propaganda about the "friendly investment climate" and "justice reform." This is concrete proof that foreign investments are not protected by the state, and even court decisions are not implemented, when there is no political interest from the government.
The companies "Malësia Solar 1, 2, 3" have not only followed every legal procedure, but have also made a concrete contribution to Albania. In 2016, the company sponsored the installation of solar panels on the terrace of the Ministry of Infrastructure and Energy.
Will another foreign investment leave?
Today, this strategic project continues to be held hostage by the bureaucracy and arbitrariness of state structures. If the KKT decision is not signed immediately, Albania risks losing a 10 million euro investment, which neighboring countries would have welcomed with the red carpet.
