Rector Artan Hoxha's decision to suspend Dorina Hoxha was overturned by the court; her reinstatement takes effect immediately, despite the appeal to the Court of Appeal
The Administrative Court of Tirana has ruled in favor of the Dean of the Faculty of Law, Prof. Dr. Dorina Hoxha, by annulling the act of the Rector of the University of Tirana, Artan Hoxha, for her suspension from duty.
With its decision, the court ordered the immediate reinstatement of Dorina Hoxha to her position as dean, determining that the decision is immediately enforceable. This means that she must be reinstated as of today, even if the losing party decides to appeal the case to the Administrative Court of Appeal.
The case began on May 20, 2026, when the rector of the University of Tirana, Artan Hoxha, signed the order to suspend the dean of the Faculty of Law. The administrative act argued that the measure was taken after Dorina Hoxha had expressed interest in running as a member of the High Judicial Council (HJC), with the aim, according to the decision, of guaranteeing institutional impartiality and avoiding conflicts of interest during the selection procedure for members of the HJC and the High Prosecutorial Council (HPC).
In the same decision, the rector appointed Professor Skënder Kaçupi to temporarily exercise the functions of Dean of the Faculty of Law.
The suspension sparked debate in the academic and legal community, where questions were raised about the legal basis for the rector's intervention in a dean elected by the university community. In public discussions, it was emphasized that the relationship between the rector and the dean is regulated by law and the principle of university autonomy, while the limits of administrative powers remain subject to legal interpretation.
The Administrative Court's decision to repeal the suspension act constitutes the most important development in this matter and restores the dean to the exercise of her mandate until another final decision is made, if the judicial proceedings continue at the highest levels.
