
The lawyers of the acting mayor of the Himare municipality, Jorgo Goro, have asked for time to familiarize themselves with the file. This has caused the session at GJKKO for his security measure to be interrupted.
Goro is accused of abuse of office in relation to the property where Artan Gaçi, the former socialist deputy and the husband of the former Foreign Minister, Olta Xhaçka, is building a strategic investment worth millions of euros.
SPAK accuses Goro of having misused his office in two episodes, in the first one by avoiding the District Council for the area of 5512 square meters of land and based on his document, the land was registered in the Cadastre contrary to the law and then sold to him by Stavri Mëhilli to former MP Gaci, with a relatively low value compared to the market.
Stavri Mëhilli had secured the property through false documents and for this reason, he is wanted, as the security measure "prison arrest" has been assigned to him. The acting mayor of Himara is also accused of the area of 5080 square meters, which also passed into the hands of Olta Xhaçka's husband in the final. Regarding this area, he has passed the responsibility to the Directorate of Land Management.
Goro stated before the prosecutors that he simply signed the reply as the owner of the institution addressed to the Cadastre of Vlora after the compilation of the documentation by the relevant directorate. But according to SPAK, Goro in collaboration with Jerasimo Bashi, at that time the director of Land Protection and Management, without carrying out verifications, forwarded forged documents to the competent bodies and on their basis, made it possible to register the surface of 5512 m2 of land agricultural state property in favor of the entity "Pribta". The prosecution further says that it has carried out actual actions on the ground of the agricultural land surface of 5080 square meters, superimposing it on a state land property. Goro is expected to appear on bail at the Special Court on Tuesday. Together with him, Vezir Gjikoka and Bilbil Aliaj will be introduced to the masses. Jerasimo Bashi and Stavri Mëhilli have not yet been found by the police, so security measures for them have not been implemented.
The Special Prosecutor's Office also extracted details from the testimony of the arrested mayor, who stated that he acted to resolve the disputes between the parties. He told the investigative group that he only gave an opinion on where the property of citizens Haris Runa and Krenar Adili could be, in order to resolve the conflict. It turns out that what is described in letter no. 731 prot., dated 18.03.2019. signed by the Mayor of Himarë, Jorgo Goro, which then served for the final registration of the property, turns out to be a circumstance that does not match the facts and data reflected in the documents and records of the protocol.
The prosecution says that from the review in this section of the register, it has been found that the Vlora District Council, for its part, has not returned any response to the address of the Himara Municipality after the administration of the request by the latter. For this reason, even after 15.04.2023, Himarë Municipality has not received any confirmation from the Vlora District Council, related to Form no. 6 or any other confirmation related to the property for which ZVRPP Vlorë has requested registration. Asked in the capacity of the person who has knowledge of the criminal offense, the citizen Jorgo Goro explains, among other things, that: "...regarding the request no. 19555 prot., dated 07.09.2016, from the Local Real Estate Registration Office Vlora, the Department of Land Protection and Management has performed its actions of which he is not aware, but simply signed the return as the owner of the institution addressed to ZVRPP Vlorë, after compilation by the relevant directorate. So, all the procedure followed for the case in question, according to SPAK, was handled by the relevant directorate which carried out the relevant verifications and the Himarë Municipality responded with letter no. 2751/1 dated 13.09.2016.
Asked what legal basis served for him as mayor, to contour the property with number 36/35, the declarant answered that he intervened to resolve disputes between citizens. This competence, according to the declarant, is foreseen in the law of local self-government and specifically that in the field of public security, municipalities are responsible for guaranteeing community relations, prevention and mediation for the resolution of conflicts in the community.
Asked about letter no. 2751/1 dated 13.09.2016, from the Municipality of Himarë, addressed to the Local Property Registration Office of Vlora, where it was stated that in ZK 1739-Gilek the process of the first, initial systematic registration (management) was not carried out and that there were no indicative maps available of registration (HTR), thus not being able to express the jurisdiction and location of the properties, while below the opinion is expressed that there is an overlap and that the properties of Haris Runa and Krenar Adili are located in the area outlined by no. 36/35, citizen Jorgo Goro replied that he only gave an opinion on where the property of citizens Haris Runa and Krenar Adili could be, in order to resolve the conflict. Asked where he started to give an opinion on the number identification of the property of citizens Haris Runa and Krenar Adili, the declarant states that the request with no. 19555 prot., dated 07.09.2016 of ZRPP
Vlorë does not provide an opinion on the contouring of the property of the citizens Haris Runa and Krenar Adili, but they as an institution have gone further in their answer when they have given an opinion that the properties of these citizens are contoured in the property with no. 36/35. "During the investigation, verifications were also carried out at banking institutions, and specifically, from the verifications carried out at the bank 'Intesa Sanpaolo', it was found that the citizen Stavri Mëhilli has a bank account and from the withdrawal of the account (movements) in ALL (Leka) currency, it results that we date 27.02.2020, the sum of ALL 12,677,600 ALL was transferred/transferred to the account of citizen Stavri Mëhilli with the description: "Transfer according to contract no. 296 rap no. 171 col dated 26.02.2020" - it says in the investigative file.
SPAK says that the whole alienation scenario regarding the registration of the land area of 5512 m2, the property with false documents, was for the purpose of selling it to Artan Gaçi. "It turns out that the representative of the legal entity, the citizen Artan Gaçi, was used by the citizen Stavri Mëhilli for the purpose of registering the property, selling it, and then benefiting from the money according to the price agreed in the sales contract with the buyer. On the other hand, the process of registration of the property in question was enabled and completed by the illegal activity and not based on any verification or official act, as well as in excess of the powers of the local government bodies, by the public officials of the Himara Municipality as well as by actions contrary to the law of employees of ZVRPP Vlorë/ASHK Vlorë".
