The government has sent a new law to Parliament today, which appears to legalize the "annihilation" of military property.
Olta Xhaçka is currently under investigation by SPAK for affairs with military properties, but Rama has decided to make the "sale" of the properties owned by the Ministry of Defense a concrete law.
But what is it about? The government has sent to the Parliament the draft law: Some additions and amendments to Law No. 64/2014, "On the powers and authorities of the direction and command of the Armed Forces of the Republic of Albania", as amended.
This law, in addition to strengthening the powers of the Minister of Defense, also has several clauses that raise many questions. The current law does not have a single article or point that talks about military property. However, the new law is “tailored” so that the minister can do whatever he wants with the property. An entire article has been added, according to which military property can be leased or agreements can be concluded with other entities that want to use it.
" Properties under administrative responsibility are administered by the Ministry of Defense or by another legal entity, established according to the forms provided for by law, at the Ministry of Defense for this purpose, in accordance with the legislation in force. Properties within and outside the deployment and distribution plan may be given for dual use, in the interest of the Ministry of Defense, as long as the operational capacities of the Armed Forces of the Republic of Albania are not violated ," the law states.
It is further emphasized that the term dual use by the Ministry of Defense implies the ability to administer state property, under the responsibility of the Ministry of Defense, both in order to guarantee the activity of the Armed Forces, and in order to develop and increase its economic value.
Finally, it is stated that the criteria and procedures for granting property under the administration of the Ministry of Defense, by lease, emphyteusis, dual use or other forms, are determined by decision of the Council of Ministers. /Pamphlet
