The Complaints and Sanctions Commission orders Chief Commissioner Ilirjan Celibashi to make a decision regarding the extension or not of the mandate for the Mayor of Kuçova, Kreshnik Hajdari.

The latter, based on the decriminalization law, loses his mandate as mayor, since he did not declare a conviction on the decriminalization form. But it seems that the matter has become a ball, being thrown from one instance to another without reaching a decision.

KAS has today ordered Chief Commissioner Celibashi to make the decision, while it is not known whether he will express his opinion regarding the continuation or not of Mayor Kreshnik Hajdari's mandate. The latter continues to lead the Municipality of Kuçova, while from the developments it seems that every mechanism is being used for Hajdari to complete his full mandate that ends in 2027.

About 3 weeks ago, the State Election Commissioner did not prefer to announce a decision regarding the request for the dismissal of Kreshnik Hajdari as mayor of Kuçova. Celibashi declared that he was in a conflict of interest, so he withdrew from the decision-making.

The case of the Mayor of Kuçova has revealed the double-standard stance of Ilirjan Celibashi, who in his role as State Election Commissioner, legitimized Kreshnik Hajdari's participation in the race, even though he had the documentation available that is now confirmed by SPAK and GJKKO. In 2023, when it was being discussed as registered candidates for the local elections, Celibashi did not forward the decriminalization form of Kreshnik Hajdari to the General Prosecutor's Office, thus avoiding a disqualification from his race.

But at the time when SPAK began the investigation, it decided to forward the file to the Special Prosecution, while due to the procedures followed, Hajdari managed not only to receive the mandate, but also to govern Kuçova as Mayor for at least two years. It seems that this situation has caused the State Election Commissioner to withdraw today without a decision, declaring that he is in a conflict of interest and still pushing forward without a solution, the political fate of Kreshnik Hajdari.

At the beginning of May, through an official letter, SPAK confirms to the CEC the conviction of the Mayor of Kuçova, Kreshnik Hajdari. The letter, signed by Klodian Braho, head of SPAK, is addressed to the State Election Commissioner, Ilirjan Celibashi, informing him that the decision against Mayor Hajdari has become final, and an order has even been issued for the execution of the sentence.

Braho's letter to Celibashi is a response that SPAK has made to the State Election Commissioner, regarding Hajdar's criminal past.

In the official document, the Special Prosecution Office explains that the criminal proceedings against Kreshnik Hajdari were registered under number 80, dated May 3, 2023, for the criminal offense "Forgery of seals, stamps or forms", provided for by Article 190/2 of the Criminal Code. According to SPAK, after the completion of the preliminary investigations, the case was sent for trial on December 18, 2023. Subsequently, the Special Court of First Instance for Corruption and Organized Crime, with decision no. 06 dated January 25, 2024, declared Hajdari guilty of committing the criminal offense.

In its decision, the court initially imposed a sentence of 9 months in prison. However, pursuant to Article 406/1 of the Code of Criminal Procedure, which provides for a reduction in the sentence in the event of a summary trial procedure, the defendant's sentence was reduced by one third, ultimately being sentenced to 6 months in prison.

In another document signed by the head of the Special Prosecution Office, Altin Dumani, it is confirmed that on February 1, 2024, SPAK issued the order for the execution of criminal decision no. 06 of the Special Court.

According to the document, the court's decision became final on July 5, 2024, which means the end of the legal process and the entry into force of the sentence.

They do not provide further details on the specific circumstances of the case or the activity that led to the criminal proceedings against Hajdari.
