
Bardhi's amendment excludes from the benefit a group of constitutional functions, but allows for the reduction of punishment for a series of criminal offenses within the competence of the GJKKO for other high-level officials
Reestablishment and the Socialist Party have joined the votes to pass the Criminal Amnesty today in the Parliament.
The condition that was not negotiated by the Reestablishment was the amnesty for those convicted by GJKKO. Berisha's grouping has also requested some changes that have been evaluated by the SP and the "agreement" of two weeks ago will be voted on in the session.
Bardhi's amendment excludes from benefiting a group of constitutional functions, such as the president, prime minister, ministers, deputy ministers, deputies and other high officials of justice and the like, but allows the reduction of the punishment for a series of criminal offenses under the competence of GJKKO- and for other high-level officials, judges, prosecutors or natural persons convicted of corruption, abuse of tenders and the like.
This change in the draft law gives a reduction of 1 and a half years in prison to men convicted by the Special Court and to 2 and a half years in prison to women and minors convicted by the same court, on the condition that they do not have or have not had when they committed the criminal offense the exclusionary functions.
Asked by BIRN if this proposal was in line with the opposition's anti-corruption action, Bardhi said that the purpose of the proposal was to stop the reduction of punishment for high-ranking officials.
"The amendment proposed by the DP Parliamentary Group expressly excludes from any kind of benefits derived from this draft law the high officials investigated or convicted by the special anti-corruption structures", said Bardhi.
He insisted that the goal of the opposition was to punish corruption at high levels also as a message to SPAK.
"I think that GJKKO and SPAK should focus on the fight against corruption at high levels and for this the Assembly should give a political message of support, not foreseeing any benefits for these cases", he added.
The 3 amendments proposed by Bardhi were also welcomed by the Minister of Justice Ulsi Manja. He himself, through a post on social networks the day before, affirmed that these requests will have the agreement of the majority. About 700 prisoners are expected to benefit from the criminal amnesty.
Meanwhile, in today's plenary session, the 5 laws of the March 7th session will be put on the agenda for voting, the voting of which was canceled by the Ethics Secretariat after the request of Reestablishment that there was no quorum for the voting of the laws.
Among these 5 laws, the one for the 1-year extension of the deadline for strategic investment laws is included, an issue which the opposition has contested a lot. Also today, MP Ina Zhupa requested an interpellation with the Minister of Tourism, Mirela Kumbaro about the law on protected areas.
3 proposals of the Reestablishment
1. Proposal to exempt from punishment and prosecution all persons tried or investigated for criminal offenses committed during gatherings and demonstrations carried out until March 31, 2024, regardless of the date of their registration.
2. Proposal for the exemption from amnesty, whether in terms of serving a sentence, reducing the sentence or criminal prosecution, all high-ranking officials investigated and/or tried by special anti-corruption structures or who are subject to the declaration of assets, as members of parliament or mayors.
3. Proposal for an increase in the amount of amnesty benefits, either in terms of reducing the sentence by 2 years for women and 1.5 years for men, or in terms of the date of the sentence, the beginning of the investigation or the commission of the criminal offense until 31 March 2024, from January 31, 2024, as provided for in the current version of the draft law.
The Law on Criminal Amnesty has in principle received the votes to be approved in the Assembly. We remind you that 84 votes are required for this draft law, so the votes of the opposition will definitely be needed.
