The internationals, in their draft, are expected to bring a firm ultimatum to stop a unilateral action by the majority with votes smuggled by the opposition...
After the strong statements of the USA and the EU, regarding the commission that the majority has set up to intervene in the reform of Justice, the internationals have started to act.
As learned, a joint draft is being prepared, which will guide the path that the Assembly should follow.
Our sources point out that, the draft will have a clear brake from the beginning, to stop the legal mitigation of crimes against corruption.
One of the first ideas of the majority, which has often been talked about publicly, is the criminal offense of Abuse of Duty.
There are several ideas for this, one of which, and the most drastic, is to remove the prosecution of this criminal offense from the jurisdiction of SPAK. Another idea is to define this issue more specifically, while other articles of the Criminal Code are also expected to be changed.
The internationals, in their draft, are expected to bring a firm ultimatum to stop a unilateral action by the majority with votes smuggled by the opposition.
In a previous statement, both the US and the EU demanded that the new draft reform be "comprehensive".
The "comprehensive" concept is very clear and requires that the new draft be drawn up through a close consultation with all justice institutions.
Starting from SPAK, the Constitutional Court, the General Prosecutor's Office, the KLP of the KLJ, the Supreme Court, as well as the School of Magistrates.
And the requests or proposals of the new institutions of justice will have to be taken as a basis. The USA and the EU have undertaken to support justice institutions, especially SPAK with detailed expertise regarding the perfection of the reform in Justice.
And it is precisely in this close alliance that the majority is expected to be "limited to what they say", limiting the range of action against SPAK.
The draft that will be prepared by the internationals in cooperation with the new justice will aim at a change of the judicial organization scheme, which has slowed down justice. On the other hand, it is expected that the arrival of magistrates who have graduated abroad in the justice system will increase as a possibility, which until now has been prohibited.
The draft is expected to be presented in a special ceremony on July 30, when it is also the anniversary of the approval of the reform in justice, where the red lines will become clear to the majority./ Pamphlet
