SPAK has sent for trial the mayor of Devolli and 4 others, who are accused of abuse of office.
The mayor of Devolli, Eduard Duro, appeared 4 days ago at SPAK, where he was informed of the end of the investigation. After leaving SPAK, Duro said that he will not resign, but will continue to stay in office. He was taken as a defendant by SPAK, as he is accused of having licensed a gas station in Bilisht, which was a construction without permission.
He is charged with abuse of office. Earlier, Duro denied the accusation, saying that he signed the legal authorization of Taxes for the sale of the entity.

The Special Prosecutor's Office against Corruption and Organized Crime submitted to the Special Court on December 6, the request for sending 5 defendants to trial; Eduard Duro, Astrit Seferkolli, Gazmend Haxhija and Gazmend Mali for the commission of the criminal offense "Abuse of duty", in cooperation, provided for by article 248, 25 of the Criminal Code and Vojsava Bregu for the commission of the criminal offense "Abuse of duty", provided for by article 248 of the Criminal Code.
Violation in the granting of permission and authorization for the company "Genci Petrol" sh.pk
From the administered acts, it appears that legal violations were found by the Bilisht Center Administrative Unit, by granting a permit in 2015 and an authorization in 2020 to the company Genci Petrol", sh.pk, for the fuel sales station in Devoll, Kapshtica. Since 2015 and following, from the granting of permission and authorization in violation of the law, unfair benefits have been realized from this company.
At the time when she held the position of Commanded Administrator of the Bilisht Center Unit, the citizen Vojsava Bregu enabled the commercial company "Genci Petrol" sh.pk with permit no. 4, on August 27, 2015 "for retail trade of fuels+LPG", with location of commercial activity in Devoll, Kapshtica.
The granting of the permit was contrary to law no. 8450, dt. 24.02.1999 and VKM no. 170, dt. 25.04.2002. The entity "Genci Petrol", sh.pk, at the time of its award, was not equipped with the required legal documentation; a. control act, b. the use permit for the gas station and c. the authorization for entrances and exits to the road from the Albanian Road Authority, as a secondary interurban road.
From the administered acts, it appears that the citizen Eduard Duro, in the capacity of the Mayor of the Devoll Municipality, in cooperation with the officials of the Revenue and Licensing Sector in the Devoll Municipality, Gazmend Haxhija and Gazmend Malo and the General Secretary of the Devoll Municipality, Astrit Seferkolli, provided the company commercial "Genci Petrol" sh.pk, with authorization no. 1543 prot., dated 23.06.2020 "For the retail sale of fuels, liquid petroleum gas and lubricating oils, at the station Bilisht-Kapshticë national road, kilometer 10, near Customs, Kapshticë".
The above authorization was given in violation of the law no. 8450, dt 24.02.1999 and VKM no. 970 dt. 2.12.2015 and at this time "Genci Petrol" sh.pk was not equipped with the required legal documentation; a. certificate of use of the gas station facility and b. authorization for entering and exiting the road from the road owner. For this illegal object, by decision of the National Inspectorate of Territory Protection no. 437, dated 04.10.2019, its demolition was also decided.
