Lawyer Kreshnik Spahiu has warned that the Supreme Court may change SPAK's security measures, both for former President Ilir Meta and Mayor Erion Veliaj.
"After 4 months, the Supreme Court will have a decision on the security measures, their easing, which includes both Ilir Meta and Erion Veliaj. When the bloodshed cools, even the security measure, for the repressive manner in which he was arrested, the measure will be changed and he will be released. Even for Veliaj. I do it professionally, I will come again, if I make a mistake, I will come here and ascertain the mistake", emphasized Spahiu.
In the show "5 Questions from Babaramo", Spahiu said that he saw double standards in the actions of the Prosecution and the Court on different issues and at different times. Here he recalled the case of Sali Berisha's son-in-law, who was acquitted by the Court.
"I think I have no way of sharing a different opinion. When it comes to the law and the standard, we are all for one standard. But we are at the part where we discuss whether the Court and the prosecution have followed the same standard. And here we have the same Court that has eased the position of Sali Berisha's son-in-law for some charges. Overall, the charges are similar, but different people. The measure of imprisonment is imposed in case of high social danger, which is true, but it should also be emphasized that the person is high dangerous or obstructing the investigation. Did Veliaj obstruct the investigation? He has been under investigation for 3 issues, the incinerators, 5D and property. The question is, did Veliaj exert pressure only for property and was cooperative for the others?" says the lawyer.
Spahiu stated that the security measure is restrictive and should not be so, if the legal standard is to be followed. He even made comparisons of figures of security measures in European countries.
"When we talk about the prosecutor's office and the court, we don't separate two here and two there, but we talk about the standard. It doesn't appear to me that there has been no cooperation for the others. We are equal to Russia, Europe has 18-22 percent of the issue of cheaper security measures, while here they are higher, is it the same standard or not? Let's remove the name Erion Veliaj and talk about the fact of the security measures, whether they are repressive or not ," said Spahiu.
The lawyer also recalls the fact that investigations can be conducted on anonymous criminal reports, when legal practice does not allow it, only in cases where the evidence is very strong.
" What is the practice that SPAK has operated with anonymous reports, which are an exception to the law. Anonymous reports are excluded from the law, with special cases when they have evidence and that lead to evidence. Within a week, the GJKKO took the incinerators to trial without Erion Veliaj and what happened, since the network was not broken, the investigation is noted to have started through the associate of Veliaj's wife. I do not understand what was the issue that led it in this direction with a three-quarter page report, from a person who submitted it in person and not by mail. What are the causes of the law that lead to this practice?" , Spahiu explained.
