Journalist Artan Hoxha spoke about the protest of January 21, 2011, where 4 protesters from the then opposition (Socialist Party) were killed.
A few days ago, Hoxha submitted a tape to SPAK, which according to him are recordings of what happened moments before the demonstrators were killed.
The journalist stated that he was questioned to the limit by them regarding the source and the person who conducted the audio interception.
Invited to the show "This Week" on News24, Hoxha has shed light on the procedures provided for by law in this case, where he said that SPAK has the right to address the court with a special request, where a secret session is held between Hoxha, a judge and a prosecutor, where the journalist is "forced" to give the name of the source.
If he does not accept, he risks being sentenced to a year in prison, which Hoxha said he has already considered could become a reality.
" When we are dealing with important issues, Albanian legislation has provided for another way of obtaining the source. Because I am a journalist and we have a Code of Ethics, for the protection of the source. The prosecution has requested the source, but the one who made the recording has done a great service to the country because he has overturned the decisions of other courts, he has said that the murders were committed on orders.
Since this serves as the starting point for reopening the case, the source is being sought. The people involved in the murders are the country's political elite. The prosecutors have insisted to the maximum extent permitted by law, but I will not give the name because I do not trust it. Bad luck left me to bear this burden. If I do not say the source, it gives SPAK the opportunity to go to court.
In a secret session, between a judge, the prosecutor and me, they force me to reveal the source. The prosecution says that the incident is very serious, I am facing a situation that is really not easy. I have considered the consequences since I denounced.
The issue is indeed of particular importance, but it is very important to preserve the source. This is the first time I have had to deal with legislation in this regard. If I do not reveal the source, the legislation provides for up to 1 year in prison.
So I say that instead of the authors in prison, journalism should end up. Seeing what happened in the past, it is very dangerous to give the source. Now we are faced with the fact, can the court make the decision on my punishment? Yes, but I do not give the source, it could create a precedent. If we are forced to give the sources, our credibility will be damaged , "he said.
