"Ora News" has learned that it is precisely this European court that finally decides, putting an end to the legal debate started in many countries, including Albania, whether the collection and distribution of data intercepted by the prosecution and the police through the crypto telephone network " EncroChat" and "Sky Ecc" is in compliance with European law.

The decision, which is expected to be taken at the end of 2023, will clarify whether the conversations transcribed in the "Sky Ecc" and "Encro Chat" applications will be valid or not, to be used as evidence in criminal proceedings initiated in several countries EU and not only.

Initially, it is expected that the lawyers on October 27, 2023, will give the conclusions and a preliminary opinion on the issue of the transcription of the conversations. While the 15 judges of the ECJ are expected to come out with a final decision at the end of the year.

After giving the decision, which will justify the acceptance or not of these conversations as evidence, further the decision will be referred to the Regional Court of Berlin.

In fact, in October 2022 it was a judge of the Regional Court of the Landgericht Berlin, who channeled this case to the European Court of Justice in Luxembourg.

The purpose of setting this court in motion is to give a final legal interpretation, if the privacy rights of European citizens have been violated and if there is a place for these conversations to be used as evidence in criminal proceedings.

One of the questions raised by the Berlin judge for the European court is the fact whether it is legal to share the hacked messages of "EncroChat" and "Sky ECC" with other EU countries and not only by French justice.

Also, the case centers on the Berlin judge's next question, whether Germany can legally use thousands of EncroChat and Sky messages received and supplied by the French gendarmerie from phones in Germany, without first obtaining legal authorization from the German courts.

German prosecutors argued that it was unnecessary to obtain a court order from German courts to transfer the data to Germany, when the data had already been obtained by the French Gendarmerie, according to a French court order.

The judicial process at the ECJ is being monitored by a large panel of lawyers and prosecutors, where Albanian jurists have also drawn attention to this trial.

In a meeting with journalists, Altin Dumani, head of the SPAK special prosecution, said that:

"... a college of lawyers, call it if you want and a union of local and foreign lawyers, have come together to bring down, through court decisions, the hacked conversations of the "Sky ECC" application, where many exponents of organized crime and officials who appear involved in criminal activity...".
