The appeal of GJKKO has upheld the decision of the first instance, for the five former officials of the Municipality of Tirana.
Redi Molla, former director of UKT, Mariglen Qato, former director of the Territory Protection Inspectorate (IMT) in Tirana Municipality, Taulant Tushe, former director of Public Works - Tirana Municipality remain under the security measure "prison arrest ". While Julian Zanaj, Director of Procurement, and Elantina Zere, director of the General Directorate of Cleaning and Greening, remain with "obligation to appear".
The five officials have the right to appeal to the Supreme Court within 45 days.
"The Special Court of Appeal for Corruption and Organized Crime, with a monocratic panel composed of judge Florjan Kalaja, today on 05.05.2024, announced the decision on criminal case no. 18 act, date 29.04.2024 registration, on complaints of persons under investigation RM, MQ, TT, JZ and EZ, with object: "Complaint against decision no. 28, dated 28.03.2024, verified by decision no. 35, dated 30.03.2024 of the Special Court of First Instance for Corruption and Organized Crime", disposed of in the case of personal security measures, and decided:
Approval of decision no. 28, dated 28.03.2024 of the Special Court of First Instance for Corruption and Organized Crime, in terms of dispositions against the appellants Mr. JZ, Mr. TT, Ms. EZ, Mr. MQ and Mr. RM
Approval of decision no. 35, dated 30.03.2024 of the Special Court of First Instance for Corruption and Organized Crime, in terms of dispositions against the appellants Mr. JZ, Mr. TT, Ms. EZ, Mr. MQ and Mr. RM
Against this decision, recourse can be exercised in the Supreme Court within 45 days, starting this term from the day after the announcement of the reasoned decision," the announcement states.
According to SPAK, the conducted investigations have proven the fact that in the period 2016-2020, during the time that the citizen Redi Molla exercised the function of the General Director of the company "Ujësjellës Kanalizime Tirana" sh.a, the trading company "Igor Elektrik" sh.pk the same as "VAS Konstruksion" sh.pk, the same as "5D Konstruksion" sh.pk, participated and was declared the winner in violation of public procurement rules in 7 (seven) procurement procedures, carried out by the contracting authority "Ujjesjellës" Sewerage Tirana" sh.a.
The fact has been proven that in the period 2016-2018, during the time that the citizen Mariglen Qato exercised the function of the Director of the Support Department in the company "Ujësjellas Kanalizime Tirana" sh.a., the above commercial entity participated and won in violation of the rules of public procurement in 4 (four) procurement procedures. In these procurement procedures, the citizen Mariglen Qato had the capacity of a member of the Bid Evaluation Commission and was part of the decision-making process for announcing the winner of the procurement procedure, for the commercial company in his possession.
The necessary evidence has been collected that proves the fact that the citizen Elantina Zere, in the capacity of the holder of the contracting authority "Tirana Parking", has favored in a procurement procedure the economic operator "VAS Konstruksion sh.pk" which is the same as "5D Konstruksion" sh.pk, creating unfair advantages and privileges for him, as well as declaring him the winner irregularly. The citizen Elantina Zere had direct communications with the citizen Nestor Muhamellari, administrator of the company "5D Konstruksion" sh.pk and the evaluation of the offers of the participants in the tender was done by the employees of the company "5D Konstruksion" sh.pk.
