The Constitutional Court has once again failed to reach a decision regarding Prime Minister Edi Rama's appeal in what is known as the "Balluku case".

Rama addressed the Constitutional Court to resolve the dispute created between the Prime Minister and the Council of Ministers on the one hand, and the Special Court of First Instance for Corruption and Organized Crime, on the other hand, regarding the suspension of the exercise of the duties of a member of the Council of Ministers.

Gathered in the deliberation room, the 8 judges of the Constitutional Court have failed to reach a decision, which means that a majority of 5 members has not been achieved to create a majority in decision-making.

The hearing has been postponed and another meeting of the Court members in the deliberation room is expected.  

The Constitutional Court's decision is expected to provide an answer to whether the measure of suspension from government duties of a cabinet member by the Court, without prior authorization, is legal or not. The Constitutional Court judges are also expected to clarify whether there was interference by the judicial power in the executive power and whether a minister enjoys the same legal immunity as a member of parliament.

The options available to the Constitutional Court are: to accept the Prime Minister's appeal, thus overturning the SPAK and the GJKKO, to legitimize the GJKKO decision, paving the way for a precedent that could jeopardize every member of the government Cabinet, or to refer the matter to the Venice Commission, for interpretation, and gaining a "golden" time for decision-making.

This is the second meeting, after the one on January 27, that the members of the Constitutional Court fail to reach a decision.

In the meeting a week ago, the Constitutional Court failed to come up with a decision, as some of the members requested more time. The lack of a decision by the Constitutional Court also indefinitely postponed the meeting of the Council of Mandates and Immunities, where another request by SPAK is being considered, that of imposing a security measure with arrest against Deputy Prime Minister, Belinda Balluku. SPAK has taken Balluku as a defendant in the Llogara tunnel case, but also in the tender procedures related to the lots of the Tirana Ring Road.

The government has asked the Constitutional Court to interpret Article 103 of the Constitution, which provides that members of the government enjoy parliamentary immunity. According to the government, the Special Court cannot suspend a minister without authorization.

On the other hand, SPAK prosecutors, Dritan Prençi and Dorina Bejko, have opposed this position, emphasizing that the suspension of a minister is not the competence of the Prime Minister and that there is no conflict of competence between the powers.

In December 2025, the Constitutional Court decided by majority vote to reinstate Belinda Balluku as Deputy Prime Minister and Minister of Infrastructure and Energy, ending the security measure of "suspension from duty" previously granted by the Special Court.

According to the Constitutional Court, the continuation of this measure risked having consequences that affect state interests and the exercise of the constitutional powers of the executive branch in determining general state policies.

A day earlier, Prime Minister Edi Rama, taking advantage of a complaint to the Constitutional Court from judges' associations regarding the salary system in the justice system, did not hesitate to issue clear warning messages to members of the Constitutional Court. /Pamphlet/
