Elisabeta Imeraj, former prosecutor, said that in the case of former Prime Minister Sali Berisha, SPAK and GJKKO established a standard that in cases where measures such as "exit ban" or "obligation to appear" can be imposed, authorization will not be required from the Assembly, when we are dealing with names that have immunity.
Imeraj said that it will be the Supreme Court and then the Constitutional Court, which will decide whether the procedure followed by SPAK and GJKKO in the case of Mr. Berisha is Constitutional or not, but so far we have a standard that I believe will applied in other cases, if any.
She said that GJKKO will most likely impose the security measure of "house arrest" on former Prime Minister Sali Berisha, based on the request of SPAK.
"In the case of Mr. Berisha, we have a stricter measure, as he refused to comply with the Court's decision, i.e. mandatory appearance and ban on leaving the country. In such conditions, SPAK requested the tightening of security measures. I think that the decision of the Court should be implemented", said Imeraj to News 24.
Referring to a phrase used by Prime Minister Edi Rama, who in one of the meetings of the Socialist Party, said that "we are not the Republic of Prosecutors", Imeraj said that it would be good if the work of the prosecution was not included in political interpretations.
"It has never happened that when the Prosecutor's Office conducted investigations against a politician, there were no political interpretations. I am for a clear separation of powers. I am not in favor of SPAK cleaning up politics, as in this way it would influence the selection in some way", said Imeraj.
