
The European Court of Human Rights in Strasbourg has ruled that Albania violated the rights of former RTSH director Thoma Gëllçi by keeping him in detention for a long period without sufficient legal grounds.
In its decision, Strasbourg considers it unfair to keep Gëllçi, who was sentenced to 1 year and four months in prison for abuse of office in connection with an additional contract for the purchase of equipment for the RTSH Agro channel, in pre-trial detention for more than seven months.
The news was announced by Gëllç's lawyer, Dorjan Matlia, while the decision was also published on the website of the European Court of Human Rights.
"The Strasbourg court ruled in favor of Thoma Gëllci today and confirmed that his arrest was illegal. The arrests have become bread and cheese for SPAK (and not only), who are more interested in showing the daily television news circus of arrests and beheadings than respecting European standards.
Thoma Gëllci, former director of RTSH, was arrested in October 2021 on charges of abuse of office in connection with a tender. He was placed in detention by decision of the GJKKO, claiming that there was reasonable suspicion of his involvement in illegal actions.
The Strasbourg Court found that the arguments for the arrest were unfounded and very general. SPAK did not provide concrete evidence as to what evidence should have been collected and why it had not been collected earlier, and that there was no risk of flight. The Strasbourg Court added that the extension of the detention was unjustified, as the investigating authorities did not show "special care" in the investigation.
According to the Strasbourg Court, Albania violated the Convention by keeping Gëllei in detention for an unjustified period and without providing evidence.
Considering it an important moral victory, Strasbourg offered a symbolic amount of moral compensation, but without forgetting to charge the state with Gëlç's legal costs.
"Now the battle will continue in our courts to put in place European justice that was distorted by SPAK's revolutionary need, with the open support of the governing majority," the lawyer announced.
