The new draft of the Criminal Code foresees sentences of up to three years in prison for anyone who misuses a person's image, by opening fake profiles on social networks or using their photograph in an unauthorized manner. According to the new article 842, titled "Illegal use of image", it is intended to curb the increasingly worrying phenomenon of online fraud and harassment.
According to the provision, anyone who opens a false profile, publishes announcements or uses the image of a person without their consent and in a way that causes them to be harassed, persecuted or humiliated risks a fine or imprisonment of up to three years. However, criminal prosecution for this offense begins only after a complaint by the victim himself or her legal representative and is discontinued if the injured party withdraws the complaint.
This change comes at a time when the phenomenon of fake profiles has reached worrying proportions in Albania, being used not only for financial fraud, but also for blackmail and attacks on personal reputation. Lawyers consider this initiative a positive step towards protecting privacy and civic dignity.
