After the services sector (bars, restaurants and hotels) and construction, within a few months, Taxes have published reference salaries for a third sector of the economy.
From April 1, for 40 categories of professions in the private healthcare system and aesthetic services, 10,000 businesses must pay their employees, according to reference salaries published by Taxes.
By implementing reference salaries, tax administrations force businesses to pay contributions and Personal Income Tax (PIT) for their employees according to the salary determined for the function held and not for the salary they actually pay them.
On the contrary, any declaration below the reference salary categorizes the declaring taxpayer as a risky entity (the tax risk assessment will not include public institutions).
But the repetition of cases of applying the reference salary is bringing disturbing reactions to accountants, businesses, and the liberal professions.
Freelance professionals in the private health sector claim that published salaries not only do not reflect reality, but are expected to harm the labor market, mainly for young people.
"Establishing a reference salary in the private sector, especially in professions like medicine, is a delicate and complex issue.
"In principle, the private market does not operate on standardized salaries, but on a series of factors such as experience, specialization, professional reputation, workload and the structure of the institution where the activity is carried out. For this reason, any attempt to establish a fixed "reference salary" risks not reflecting the reality of the market," underlines psychiatrist Neli Demi.
Other freelance professionals in the private medical service sector, including managers of clinics and diagnostic centers, claim that a young, inexperienced nurse cannot be paid 80,000 lek, at the same levels as a nurse with years of experience.
"Implementing a reference salary will damage the meritocracy system in the private sector. The reference cannot be unified at the national level, since the flow of patients in a clinic in Tirana is higher than in other cities. Also, scientific degrees and professional skills are not taken into account," the director of a diagnostic center in Tirana told "Monitor".
He added that medical titles are grouped incorrectly, such as the pathologist profession being included in the same salary group as the surgeon. This, he said, will negatively affect the labor market, especially the "brain gain" for young people who graduate abroad.
“Problematike zbatimi do të jenë edhe për spitalet private, veçanërisht te punësimi i mjekëve të dypunësuar (që punojnë në shtet dhe privat, sepse e lejon ligji), sepse në sistemin privat pagesa kryhet përmes faturave të shërbimit. Edhe kjo gjë e vështirëson zbatimin praktik”, tha ai ndër të tjera.
Të njëjtën shqetësim ndajnë edhe drejtues të farmacive dhe qendrave stomatologjike, sipas të cilëve p.sh paga e 110 mijë lekë për një farmacist të ri apo dentist nuk mund të zbatohet tërësisht në treg.
Edhe mjeku psikiatër Neli Demi thotë se në praktikë, tregu i shëndetësisë funksionon më mirë kur lejon diferencimin real sipas formimit, orëve të punës për secilin punonjës, dhe jo kur e kufizon atë me skema të thjeshtuara që mund të duken të drejta në teori, por nuk qëndrojnë në realitet.
“Një psikiatër i ri, në kushte të caktuara, mund të paguhet edhe 200 mijë lekë por problemi lind kur kjo shndërrohet në normë reference. Sepse atëherë nuk po flasim më për reflektim të tregut, por për vendosje artificiale të një tavani.
Edhe brenda kategorisë “mjek i ri” ka diferenca të mëdha. Cilësia e formimit, aftësitë klinike, konteksti ku punon, kërkesa në treg. Reduktimi i gjithë kësaj në një shifër fikse është jo vetëm i pasaktë, por edhe i dëmshëm.
Më shumë se sa një reflektim i tregut, kjo shifër rrezikon të funksionojë si një kufi referimi që mund të ulë standardet, në vend që t’i përmirësojë ato. Në këtë kuptim, nuk mendoj se kjo qasje është as realiste dhe as në përputhje me mënyrën si funksionon sektori privat i kujdesit shëndetësor”.
Kontabilistët: Referencat nuk janë kushtetuese
Për kontabilistin Sotiraq Dhamo, referencat nuk janë kushtetuese dhe nuk duhet të zbatohen automatikisht. Ai thotë se ato mund të përdoren nga Tatimet vetëm për vlerësimin e riskut, por jo si një bazë për vendime apriori për pagat ose tatimet.
Së dyti, Dhamo thekson se vendosja e pagave të referencës është jashtë parimeve të tregut të lirë dhe i ngjan një ekonomie të centralizuar si gjatë kohës së socializmit, ku çmimet dhe pagesat vendoseshin nga komisionet e shtetit.
“Administrata tenton të mbulojë dobësitë e saj me rregulla të tilla dhe se kjo nuk është mënyra e duhur për të luftuar informalitetin në paga”.
Kontabilisti Dhamo gjithashtu thotë se tregu është i lirë, dhe nuk duhet të lejohen diferencime në paga, sepse pagat e referencës mund të kenë efekt negative.
“Për shembull, nëse një infermiere paguhet realisht 130,000 lekë, por referenca është 80,000 lekë, atëherë 50,000 lekët e mbetura shpesh jepen “në dorë”, duke krijuar evazion me “bekimin” e pagesës së referencës”.
Ai përfundon se shoqatat dhe dhomat përkatëse duhet të kundërshtojnë masa të tilla nëse nuk janë dakord, për të mbrojtur interesat e profesionistëve dhe integritetin e tregut.
