The deputy of the Socialist Party, Plarent Ndreca, has discussed the vote in the Parliament that overturned the request that the mandate of the deputy Olta Xhaçka be examined in the Constitutional Court.
Ndreca said that the Assembly is obliged to implement all the decisions of the Constitutional Court, but according to him, there is a 2016 decision of this court that says that if "the alleged incompatibility is not directly related to the deputy, then there is no room for to go to the Constitutional Court, since there is no case'.
He said that so far doubts have been raised in the media and public opinion, but from SPAK there is no doubt about Olta Xhaçka's husband.
"We have it as a point of reference when Bardhi speaks. What I want to say is that the Constitutional Court was considering it. The constitutionalist has done a foundation process for 10 hours. The parties, lawyers and Ms. Xhaçka herself were asked. In the end, the Constitutional Court decided to suspend. So no fundamental decision has been taken.
While it has abolished... The truth is that the Assembly has an obligation to respect the decisions of the Constitutional Court. But the Assembly has the duty to implement all the decisions of the CJK, including the one of 2016 which says that if the alleged incompatibility is not directly related to the deputy, then there is no place to go to the Constitutional Court at all, because there is no prima facie case. so at first glance there is no issue as long as it is not directly related to the deputy.
Doubts are raised by the media, by public opinion, but there is no doubt from SPAK. Up to the moment we are talking, there are doubts about the mayor, but not about the deputy's husband. You connected it with the land, the land was bought later", said Ndreca speaking to Euronews Albania.
