Journalist Elton Qyno was at the premises of the Special Prosecutor's Office against Corruption and Organized Crime from 11:00 am yesterday until 2 am today.
From his apartment, Qyno stated that he was held at SPAK until 17:00 and was informed that there was a Court decision to search his house, office and vehicle.
Among other things, the journalist said that after the statement given, there was pressure to reveal the source of the information.
Regarding this event, dozens of journalists have reacted in support of their colleague, while asking SPAK to urgently make the session with Qyno transparent.
The head of Infochip, Gerti Shella, has reacted to this event on the verge of scandal, as he has also published the law on the preservation of professional secrecy by the media.
The reaction of the head of Infochip, Gerti Shella:
According to media reports, journalist Elton Qyno was questioned by SPAK for reasons related to the exercise of the profession of journalist.
Article 159 of the CPC guarantees the preservation of professional secrecy, regardless of whether the legislator has sewn this article to return it according to the utility (as happens in Albania where laws are sewn and this way and never as a good law should be, read the article at the end to the post...).
SPAK, with its action, has made relations with the Media hostile, which is actually its only ally in these times, where its own reputation is at stake. In this sense, SPAK acted wrongly.
If not, the Media Officer in SPAK must make an urgent public clarification of what has motivated SPAK to request a court decision for the control of the residence of a journalist who covers the prosecution and who is aligned on the same front against corruption and organized crime like SPAK itself.
SPAK is in an unequal war with powers much more powerful than itself.
The media, the fourth power, is the natural ally of SPAK. Whoever convinced the prosecutor of the Qyno case that the journalist is the enemy (and not an ally), lied to him...
The issues that SPAK is investigating today are reported affairs, even investigated to some extent by journalists like Qyno and her friends. This truth cannot be erased by SPAK.
SPAK must publicly clarify its position why it was forced to hit a reliable ally... and what measures it will take to restore the lost trust in the eyes of the media representatives.
This should not be a prelude to the loss of trust in the eyes of the public, which finds it difficult to believe that the problem lies with journalists...
Article 159
Preservation of professional secrecy
1. They cannot be forced to testify as far as they know because of their profession, except in cases where they have the obligation to refer to the prosecuting authorities:
a) representatives of religious beliefs, whose statutes are not contrary to the Albanian legal order;
b) lawyers, legal representatives and notaries;
c) doctors, surgeons, pharmacists, obstetricians and anyone practicing a health profession;
ç) those who practice other professions, to whom the law recognizes the right not to testify about those related to professional secrecy.
2. The court, when it has reason to suspect that the claim made by these persons to avoid testifying has no basis, orders the necessary verifications. When it turns out to be unfounded, the court orders
the witness to testify.
3. The provisions provided for in paragraph 1 and 2 also apply to professional journalists regarding the names of persons from whom they have received data during the exercise of their profession
. But when the data is necessary to prove the criminal offense and the truth of this data can only be revealed through the identification of the source, the court orders the journalist to show the source of his information.
