Sali Berisha was invited to the show "Te Paespozuarit" on MCN TV, where he was asked by Ylli Rakipi, why he did not implement the court's decision on the security measure "obligation to appear" requested by SPAK, just as Monika Kryemadhi did. which is free despite investigations by SPAK and Berisha would not end up under house arrest.
The former prime minister said that he could not implement a decision in violation of the Constitution.
Ylli Rakipi: You would be free today like Monika Kryemadhi, with mandatory appearance. You have aggravated the positions yourself. If I were you, I would choose to show up. They even took the opportunity to put you in there. It's not that Altin Dumani, who you call an enemy now, told you not to follow the court's decision.
Sali Berisha: This is an extra-Constitutional reasoning. Why? I rejected the court's decision because the Constitution requires that the decisions be legal. Every order sanctions that the unlawful order shall not be enforced. Secondly, what was decided was a coup d'état within the state, taking over the power of the Parliament, from the judges to give it to Edi Rama. I was the person who had sent in 2012 the amendment for the abrogation of Article 73 of the Constitution, which forced the judicial bodies to obtain authorization from the Parliament, before imposing restrictions on the MP's freedoms, any freedom. This was categorically opposed by Edi Rama. The Council of Europe also opposed it, so I was also clear that those judges wrote the Constitution with their decision, I could not be part of a coup, of people who have no law and morality.
The CJK, again in its decision, testifies that the decision was anti-Constitutional, because according to them it violated the principle of proportionality, a principle sanctioned in Article 17 of the Constitution. Why did I bring it up here? Because the court decision was anti-Constitutional. There is another article, 15, which states that rights and freedoms are indivisible. If one or three or five individuals decide to take a hostage or enslave, decide to write the Constitution or violate it, I never do it.
Ylli Rakipi : Then don't say that SPAK isolated you, you went there yourself. They have taken a second measure because you did not accept the first. Monika Kryemadhi went.
Sali Berisha: In the law, in letter, in spirit and in precedent, in the case of Tahir, it could not happen without the approval of the Parliament. With me, a handful of thugs never created an anti-Constitutional precedent. They could never do it. I was not the one who could violate the Constitution.
