The procrastination for the mandate of the president of the Constitutional Court, Holta Zaçaj, continues.

The Constitutional Court has once again postponed the session for examining the request of the president Holta Zaçaj regarding the end of the judge's mandate.

The Constitutional Court informed that it has administered the documentary practice of the Supreme Court that accompanied the procedure for filling the vacancy and the election of Holta Zaçaj as a member of the Constitutional Court.

The court found that, on 16.12.2024, judge Holta Zaçaj was familiar with the documentary practice sent by the Supreme Court, while before today's session she filed a written request, through which she requested the granting of sufficient time to present its opinion regarding the position held by the President of the Supreme Court regarding the constitutional principles and the way of interpreting the constitutional provisions applicable in the case under consideration.

After assessing the reasons for this request, the Court decided to accept it, leaving time until Monday, 23.12.2024, at 10:00 a.m. , to present a written opinion. At the same time, the Court decided to adjourn the session to the same day, at 13:00, to give the panel the time necessary to review the presented document in advance.

The next session is expected to be decisive for the case under review.

"Today, on 17.12.2024, at 1:00 p.m., a hearing was held to examine the request of the President of the Court for the declaration of the end of the mandate of Judge Holta Zaçaj.

The court found that, on 16.12.2024, judge Holta Zaçaj was familiar with the documentary practice sent by the Supreme Court, while before today's session she filed a written request, through which she requested the granting of sufficient time to present its opinion regarding the position held by the President of the Supreme Court regarding the constitutional principles and the way of interpreting the constitutional provisions applicable in the case under consideration.

The court, after evaluating the reasons for this request, decided to accept it, leaving time, according to the request, until Monday, 23.12.2024, at 10:00, to submit a written opinion.

For these reasons, as well as to give sufficient time to the body to study the opinion in advance, the Court decided to postpone the session to Monday, 23.12.2024, at 13:00", announced the Constitutional Court.

The Supreme Court considers Zacaj's mandate to end on March 10, 2025, while declaring the position vacant and starting the procedures for her replacement. President Zaçaj herself says that her mandate ends at the end of 2025 and for this she has asked the Venice Commission for an opinion.
