The Court of Appeal accepts the request of the Prosecution, leaves Mario

The Court of Appeal upholds the decision of the first instance for the security measure "arrest in prison" for 14-year-old Mario Perlleshaj, suspected author of the murder of Martin Cani.

The juvenile's lawyer asked for a lighter security measure than that of arrest in prison with the argument that his client committed the murder in self-defense.

"On the request of the Prosecutor's Office at the Court of First Instance of the General Jurisdiction of Tirana, a trial has been held regarding the assessment of the legality of "arrest in flagrante delicto" and the determination of the measure of security "arrest in prison", provided for by Article 238 of the Criminal Code .Pr. Criminal, to minors in conflict with the law, the citizen "...", suspected of committing the criminal offense "Murder committed under qualifying circumstances", provided by article 79 letter "a" of the Criminal Code.

At the end of the trial, the Court of First Instance of the General Jurisdiction Tirana, with the decision no.... dated 22.11.2024, has decided:

- The assessment as legal of "arrest in flagrante delicto" against a minor citizen in conflict with the law "...."

- The assignment of the security measure "arrest in prison", provided by article 238 of the Criminal Code, to the minor citizen in conflict with the law "...", suspected of committing the criminal offense "Murder committed in qualifying circumstances ", provided by article 79 letter "a" of the Criminal Code.

- The Judicial Police is charged with the implementation of this decision.

- Against this decision, an appeal is allowed in the Court of Appeal of General Jurisdiction.

The case on appeal was examined on the basis of the complaint submitted by the minor in conflict with the law, the citizen with the initials "...".

At the end of the trial, today on 17.12.2024, the Court of Appeal of General Jurisdiction, composed of the panel with Judge Ms. Elona Mihali, decided: - Approval of the decision no..., dated 22.11.2024 of the Court of First Instance of the General Jurisdiction of Tirana", the Court's announcement states.

We remember that the event happened a few weeks ago near the "Fan Noli" school in Tirana, where 14-year-old Martin Cani died after a fight with a knife.

On this occasion, there was a strong reaction from the civil society where several protests were organized in front of the Ministry of Education, where the resignation of Minister Ogerta Manastirliu was also demanded.
