An information received in "Pamfleti" reveals a scandal in the dome of the General Prosecutor's Office, with the author Olsian Çela and the beneficiary the Economic and Financial Director of this institution, Luan Abazi.
The scandal is this: In December 2019, when Olsian Çela was elected and began his duties as chief prosecutor, General Secretary Luan Abazi commanded the Economic and Financial Director of the Prosecutor's Office.
According to the law, while he accepted the position of secretary, which is the No. 2 management position in the institution, Luan Abazi had to give up his position, but in a bargain with the chief prosecutor Olsian Çela, for 4 years he continues to hold both high positions .
Referring to the powers he has as Secretary General, Luan Abazi is responsible for the preparation, implementation, internal financial control, monitoring, reporting, accounting and internal audit of the budget of the prosecution in the center and districts.
He even plans and announces tenders, auctions and any investment, expenses, salaries, per diems, appointment and dismissal of employees and any administrative action in the General Prosecutor's Office.
It is absurd, the fact that as finance director, Luan Abazi presents requests to himself as General Secretary, and implements the orders and tasks he leaves to himself, even makes tenders and reports to himself.
With or without premeditation, this is a circle closed in one hand, for bargains and corruption even in the central dome of the high prosecution institution, which has the task of directing the investigation structures and the fight against crime and corruption.
Because this is what Olsian Çela has decided and has been doing for 4 years, so that his Lion has in his claws the financial-administrative activity of the General Prosecutor's Office, without asking about the law.
This constitutes a serious scandal, according to the General Secretary, he cannot also be the Economic-Financial Director or vice versa; because in the present case it is the same person and he cannot hold two duties, one of which is dependent and controlled by the other.
The other scandal is the fact that the Chief Prosecutor does not have the right to appoint or command the Secretary of the General Prosecutor's Office, but according to Article 66 of Law 97/2016, he is chosen by the High Council of Prosecutors through an open public competition.
But the High Prosecution Council is also involved in this scandal, after 4 years, it is allowing the office of the Secretary of the General Prosecution to be performed by a person under command, who is also the finance director.
While SPAK has a legal obligation to investigate this scandal within the genre in terms of tenders worth millions of Euros, which for 4 years, chief prosecutor Olsian Cela and his Luani as finance director and secretary, have been making closed with the names " state secret", when they are not such./ Pamphlet
