A judge in Colorado has allowed former President Donald Trump to continue running in the state next year, rejecting a request to disqualify him for actions before Jan. 6, 2021, when the Capitol was stormed by his supporters.
The ruling by Judge Sarah Wallace, which is likely to be appealed, is a victory for Mr Trump, who is facing a series of challenges to his candidacy based on a section of the US Constitution that bars people from holding federal office. who have engaged in insurrection or rebellion.
The issue in Colorado was raised by a group of voters assisted by the Washington-based organization Citizens for Accountability and Ethics. This was the first lawsuit to be decided at trial and serves as a test case before other similar lawsuits are considered.
Lawyers for the plaintiff voters argued that former President Trump engaged in sedition by spreading false claims of widespread election fraud after his loss in the 2020 presidential election, as well as by calling supporters to a rally in Washington and becoming calls to march on the Capitol, where Congress had gathered to certify the election results. Thousands of Mr. Trump's supporters then stormed the Capitol, attacked police and forced lawmakers to flee for safety. The attempt to stop the election certification failed.
Lawyers for former President Trump said he had no ties to the far-right groups that played a key role in the attack and that his statements before the riots are protected by the right to free speech.
The ruling applies only to the Republican primary and general election in Colorado. According to political researchers, this state is considered to vote in favor of Democrats in general elections.
The decision is the latest setback to efforts to disqualify Mr. Trump from running. Courts in Minnesota and Michigan have refused to disqualify him from running in the Republican primary, but have not ruled on whether he can run in next year's general election.
The judge's decision in Colorado can be appealed to the highest court of this state and subsequently to the Supreme Court of the United States, where the majority of judges are conservative, 6 to 3, among them three appointed by former President Trump./ VOA
