The lawsuit for the partial annulment of the decision that increased the reference prices of apartments in Tirana has been examined for the first time in the Constitutional Court.

In the first session held, the builders argued that the decision has a retroactive effect, affects profits, but has also increased construction costs.

"VKM immediately applied a drastic increase in the tax increase based on surveys where it was said that there is an increase in prices in the market. This is not an argument. Reference prices have increased by 30%-60%. And it is said that informality will be fought with the increase of taxes. But when prices go down, should the government cut taxes? There may be an oversupply in the market, but with constructions, why is this being done ", said the builders' lawyer.

" The effect of the law affects every person who has an apartment in Tirana. The price of an apartment with this law will be in the new prices dictated, and a depreciated building, this law does not take into account the age. You sell as much as you want, but you will be taxed the same. The reference price in itself is not aimed at taxation but at formalization .

Government representatives rejected these arguments as according to them the law has no retroactive effect.

" There is no retroactive power, but with the change of the average reference price of housing, it brings the effects for the future. It has nothing to do with the way of extending the effects in time ", said the government's lawyer.

After listening to the parties, the president of the Constitutional Court announced the postponement of the session in order to bring new data and evidence. The changes in the decision that brought about the increase in reference prices for 32 cadastral areas entered into force in May 2023./ A2CNN
