Justice in 2016, how it turned into a "scary" power!

It is very likely that the actions of SPAK prosecutors will stir, shock, or even cause drama in the entire community where the signature of their procedural act enters. 

Today, there is no doubt that the new judiciary, emerging from the 2016 reform, has turned into a power that produces daily acts that have a great public impact. Of course not everywhere, not in every case.

SPAK, GJKKO and the Supreme Court have the greatest weight. And less, even much less, the ordinary prosecutor's offices and district courts. However, even there the situation is quite different. After all, reform in justice is not only a change of staff, and this is the big misunderstanding.

The reform in justice is above all a change in the concept and philosophy of a power that was a pyramid. So that every judge and prosecutor is appointed by politics, and then only the chief prosecutor gave the permission to open important files. Today, the prosecutor's office has turned into a power in itself, where every prosecutor can open files, every prosecutor can open criminal cases and declare defendants, but all this only with a court decision.

Today, there are endless wiretappings, independent of SHIK, whose wiretapping office had turned into the center of mafioso political infection in the country. It is carried out by the National Bureau of Investigation, with the authorization of the prosecutor, who ratifies the decision in court. Today, the new justice has become a total power, where everyone has been talking on TV panels for over two years.

Sali Berisha and Ilir Meta, who are the people who control most of them and the guests they send, today the people who attack the most are Altin Dumani as the head of SPAK, the prosecutors who have opened the files against them, and of course the judges of GJKKO, Appeals or the Supreme Court that confirm and ratify the decisions against them.

Now everything has entered a path that is irreversible. And yet, the debate not only until today, or even today, but also in the future will not be directed towards SPAK.

The institution that has the basic power to pursue politicians and high officials. And in fact the debate does not stop, as on the other hand the whole policy feels pressured and under pressure by the special prosecutors. In fact, they are not only influencing the orientation of a debate, on the "frightening omnipotence" of SPAK, but also transversal alliances of thoughts and concepts towards or against SPAK are being created. Expectedly, chances are this is just the beginning.

What about SPAK, its prosecutors, who controls and supervises them? No one in reality. They are totally independent in every investigation they undertake, in every procedural step to declare persons under investigation, defendants, or to arrest.

It is very likely that the actions of SPAK prosecutors will disturb, shock, or even cause drama in the entire community where the signature of their procedural act enters. But this is a real risk for that community that has never in Albanian history been vulnerable to justice, only when it was decided by the great of the country.

This suffering of politicians and officials is like music to the ears of the public, of ordinary people, who are not sadists at all, but want to see a little "reciprocity", a little "fellowship" in the long ordeal they have gone through in years years, being mistreated by the ruling class of this country. That's why no one feels either regret or satisfaction in the end, since we don't have the scenes of a hysteria that happened in the dictatorship or even in post-communism, when politics encouraged militants to get excited about punishing political opponents.

However, the cardinal debate about SPAK and its prosecutors is the one that Erion Braçe opened a few days ago. Should it be the long impunity that has been the cause of the establishment of SPAK, as a priority of their work, the order of a work with objectives, or the pursuit of the violation of laws by officials, which could be corruption, misuse of duties, or conflict interest?

This debate is more than moral, more than procedural, it is cardinal. As is cardinal, the phenomenon of tolerance of the "Untouchables" who day by day violate not only the organic laws, but also the criminal code, even though they are under established regimes under investigation.

Is the law equal for all? Because, in reality, there can be no caste or strata that someone can even trample a little, and someone will eat it more.

As for what SPAK will influence and influences politics, it is more than clear that it has become the basic factor of the political line. Today, fear is the leader, and whether it will be another phenomenon.
