The third reason why this decision pleases Edi Rama and the majority is the fear of a dangerous precedent for former prime ministers.
The decision of the court on the release of Sali Berisha returns the latter to the situation where he was. Under investigation by SPAK and obligation to appear. So it is not understood what Berisha gained when he was free even before and went to house arrest after refusing the decision of the prosecution. However, it is good that this release from house arrest returns the situation as it should be and as it was a year ago, where justice continues its investigations and work and Mr. Berisha continues his political activity until the end of the judicial process .
In this sense, the decision to release Sali Berisha was a decision that satisfied all the actors in the game. It pleased the opposition, no doubt, but also the majority and justice.
The opposition is clear why. It now has its leader at liberty and can carry out his political activity. Some of them even go so far as to say that this is the sign of victory in the upcoming elections. This is good for the political race in Albania. Right now, the opposition will no longer have the alibi of participating in the elections with its leader under house arrest.
The majority is also satisfied with the release of Mr. Berisha for several reasons. First, because the political opponent's accusations that the court and justice are being used by Edi Rama to attack the opposition fall. The fact is that it has been some time since the "regime" courts have given decisions in favor of Mr. Berisha. The Court of Appeal that gave the logo, the Constitutional Court and the GJKKO today with the decision to release Berisha.
Edi Rama emerges from this decision not as a man who has captured the courts, but as a man under whose government the courts deliver justice, just as the opposition declared today. The second reason is the fact that if Edi Rama wins the 2025 parliamentary elections, he will do so by defeating an opponent and this will legitimize him more in his fourth term. A victory with the opposition leaders under arrest would be an illegitimate mandate and would hardly be able to go to the end.
The third reason why this decision pleases Edi Rama and the majority is the fear of a dangerous precedent for former prime ministers.
In the end, this decision also satisfies the Albanian judiciary, which is often under strong criticism and political attacks for being one-sided. Therefore, today's decision of the court considered Mr. Berisha's stay under house arrest as exaggerated and removed a great weight from her responsibility. Even though Mr. Berisha was under house arrest not as a result of justice but as a result of his behavior with him.
But the most important thing in this story is the fact that the decisions of the courts in Albania must always be implemented. This is a culture that must change if we really want to create a democratic culture and respect for institutions. Because in the free societies we live in today, the possibilities of seeking justice are endless. There are approximately five degrees of justice where you can claim your right. There is the first instance, the second instance, the Supreme Court, the constitutional one, and even the Strasbourg one. Therefore, if you are right, sooner or later the right will prevail. This is the only way legal battles are fought. They are done in court and not by political means. Decisions are not considered fair when they are in your favor and captured by the regime when they are against you.
