Why is SPAK delaying the election of the new head of BKH? The game being played

The chances of electing the new director of the BKH by August 31 are zero. Because the Special Commission for the Verification of the Character and Assets has not yet started the control of the seven candidates, which means that there are still no letters to the secret service and other institutions charged by law, which will respond to the character of the contestants. And to control their assets based on the declarations that Gledis Nano, Gentian Ndoj, Elton Kërluku, Andi Pogace, Gentian Shehu, Artur Beu, Joni Keta have submitted to the ILDKPI.

Since the end of the tests (July 28) with a special commission (three prosecutors who led this competition), the second commission must now carry out the assessments. Its content includes an anti-corruption judge, two SPAK prosecutors, and two BKH investigators, one as the law states comes from the financial section and he was Mr. Elton Kërluku. But the investigator turns out to have resigned from the control commission, since as a contender for the leadership of BKH he could not control himself and the other 6 competitors.

However, this was not the reason why the BKH will have a new chief so late. The entire machinery reacted sleepily to show (perhaps) that even if new institutions are established, as the BKH was baptized as the Albanian FBI, it is difficult to cultivate a new mindset with rules that do not exceed the law.

It was the KLP's delayed reaction to the Hajnaj impasse and the battle it waged since December 2024 in a lengthy correspondence that exposed the communication crisis within the special structure.

The competition also opened late, but even when the deadline for submitting documents officially closed, it was postponed with unjustified additional time and beyond protocol.

As if this were not enough, it was said that due to preferential reasons for a contestant, a debate between three SPAK prosecutors part of the first commission was closed with a slamming door.

The second commission, chaired by Mr. Eneid Nakuci, was only able to hold one meeting at the end of July before going on vacation, during which time the documents were not yet ready. Therefore, another additional meeting was given.

Regarding the new director who will clearly be late, and this is not a five-minute bus delay, on August 6, SPAK gave me this answer:

"The selection process for the Director of the National Bureau of Investigation (BKH) is in the phase of verification of the profile and declaration of assets, in accordance with Article 6 of Law No. 95/2016 “On the organization and functioning of institutions to combat corruption and organized crime”. After this process, the Selection Commission determines the best candidate, who will undergo a training program. After its completion, the name of the selected candidate is sent for approval to the High Prosecutorial Council (KLP)."

So, when the second committee completes the review, it will pass it on to the first selection committee (3 prosecutors Altin Dumani, Arben Kraja, and Behar Dibra) who, without prejudice, will find the best one.

It will take time for the KLP to think, but not long if the favorites remain favorites.

However, until this happens, decisions about who will lead the BKH will be made by the inertia of the law.

Second, the KLP is holding two meetings, neither of which will be to announce the new director of BKH.

One will be on the agenda: the end of Ms. Hajnaj's five-year mandate, which should likely occur by September 1st.

And the next meeting, on September 15th, will be to open the competition for the new head of SPAK, given that Mr. Altin Dumani's mandate as the special chief prosecutor ends in December.

In the midst of these procedures that are taking place in parallel, it is not surprising that with the departure of Duman, who from December will return to being a simple prosecutor at SPAK, he leaves behind a BKH director who will either have the fate of the first woman at the head of the Albanian FBI, being bypassed by SPAK. Which means that the new BKH director will also be at war with the new SPAK director. Or he will be just as powerful.
