An Albanian immigrant has been granted the right to reside in the United Kingdom, despite strong calls for his deportation, in a case that has sparked major public and political debate.

Klevis Dishen, 39, who entered Britain illegally as a minor and used a false identity during a failed asylum application.

His case came back into the spotlight after British authorities sought his deportation due to a criminal conviction.

Disha was sentenced in 2017 to two years in prison after being caught with 250,000 pounds which she could not justify, being considered illegal income, reports the Daily Mail.

Under British law, a sentence of over a year usually leads to automatic deportation.

However, after a long series of appeals and court hearings that lasted several years, the court ruled in his favor.

Disha's lawyer argued that deportation would have serious consequences for his 11-year-old son, identified as "C."

According to the defense, the child has difficulty with eating and follows a very restricted diet, including refusing to eat common foods outside of Britain.

One of the details that attracted attention was the claim that the boy would not consume the "chicken cutlets" available in other places, due to sensitivity to the texture of the food.

The court acknowledged that, even though there is no formal diagnosis of autism, the child has specific needs that must be taken into account.

The judge ruled that deporting Disha would be “unduly harsh” on his son and would violate the right to family life, protected by Article 8 of the Human Rights Act.

This decision thwarted the Interior Ministry's efforts to remove him from the country.

The case has prompted strong criticism from some quarters, which see the decision as an example of the misuse of human rights laws.

On the other hand, defenders of the decision argue that the best interests of the child should be a priority.

The Klevis Disha case is expected to remain a controversial precedent in the debate over immigration and human rights in Britain.
