The Court of Appeal has decided the security measure of "prison arrest" for 21-year-old Jorgaq Thëngjilli, who a few days ago had an accident with the couple near the prime minister's office.
The 21-year-old resident of Tirana was arrested on November 5, after hitting a young couple on the sidewalk near the Prime Minister's Office, after losing control of the vehicle he was driving. It was reported that the young man was speeding beyond the permitted limits.
After the accident, he was tested with "Drager" and "AquilaScan" and it turned out that he had not consumed alcoholic beverages or narcotics.
The 21-year-old was punished earlier for not regulating speed in residential areas.
"Referring to previous reports in the media, the Court of Appeal of the General Jurisdiction informs the following: On 05.11.2023, around 14:00 on the street "Ismail Qemali", the citizen with the initials J. Th while driving the vehicle, has lost his control, it is suspected that due to the speed exceeding the allowed rates, he had an accident with the citizen with the initials DK and the citizen with the initials KD
The Court of First Instance of the General Jurisdiction of Tirana has conducted the trial related to the legal evaluation of the detention and the determination of the security measure "arrest in prison", against the person under investigation, the citizen with the initials J.Th, suspected of committing the crime criminal "Violation of traffic rules", provided by article 290/2 of the Criminal Code.
The Court of First Instance of Tirana General Jurisdiction, with decision no. Act 2598, dated 08.11.2023, decided:
The assessment as legal of the arrest in flagrante delicto of the person under investigation J. Th.
2. The appointment as a measure of personal security against the person under investigation J.Th, "arrest in prison", provided by article 238 of the Penal Code.
The case on appeal was examined on the basis of the appeal made by the person under investigation with the initials J. Th, who requested a partial change of the decision, the assignment of a milder security measure such as "House arrest", "Compulsion to appear in the judicial police" or "Prohibition of leaving the country".
At the end of the trial, today on 21.11.2023, the Court of Appeal of General Jurisdiction, composed of the panel with Judge Ms. Irida Kacerja, decided:
- Approval of decision no. 2598 Act, dated 08.11.2023 of the Court of First Instance of General Jurisdiction Tirana" , the announcement states.
