The GJKKO has rejected a request from the family of Ervis Martinaj, who has been missing for 3 years, to remove his assets from seizure.
The Special Court rejected the request on the grounds that it was not based on the law, while the family members claim that the procedural deadlines foreseen in the investigation have passed.
Judge Erion Bani decided to dismiss the request filed by the family's lawyers. In his decision, Judge Bani states that SPAK has requested an extension of the investigation period, and if confiscation is not requested, then the assets are unblocked.
"The request to terminate the security measure is unfounded in law and evidence, as the prosecution has the authority to investigate for two years from the seizure, based on the law. There are several requests to extend the seizure and the extension of the seizure period has been decided twice until December 2025," Judge Bani announced.
The Court assesses that the Prosecution filed the request for confiscation within the legal deadline and therefore we are not in the conditions for termination.
In 2023, by decision of the Special Court, 34 assets were seized from Ervis Martinaj and his family members and persons associated with him.
In the next session at the GJKKO, at the request of SPAK, the persons who own Ervis Martinaj's properties, including his father Mustaf Martinaj, are expected to be questioned as witnesses.
Martinaj has been missing since August 2022, and there is still no response from law enforcement institutions on the fate of the man described as the 'king of gambling'.
Ervis Martinaj is one of the names in the "Golden Bullet" file, after the justice minister Nuredin Dumani accused him of ordering several murders. While SPAK has included him in the file as a defendant, the Kurbin Prosecutor's Office is investigating Martinaj's disappearance.
