Constitutional Court judge Elsa Toska resigned today. Elsa Toska states in her letter that she is leaving for personal reasons.

With the departure of Toska, the Court remains with 8 members out of 9 that it has in its organics. This situation is expected to complicate decision-making, since in case of a decision-making with 4 to 4 votes, the Constituent Assembly cannot come up with a decision.

It is expected that the Constitutional Court will issue an official statement.

Since 2019, Elsa Toska was one of the 9 members of the Constitutional Court. Previously, Toska has been a legal advisor for 12 years at the Constitutional Court.

She graduated from the Faculty of Law in 1996-2000, as well as a doctorate in constitutional and administrative law. Toska started her career as an assistant/commissioner of the People's Advocate and since 2007 worked as a legal advisor at the Constitutional Court.

She has also worked as a lecturer in several universities in the country and collaborated as an expert with a number of international organizations.

Who is Elsa Tosca?

Judge Elsa Toska tied the knot on 05.06.1976 in Kavaja. He graduated in 2000 from the Faculty of Law at the University of Tirana. In 2005 he received the title "Master" in European Studies at the Rectorate of Tirana, while in 2012 he received the scientific degree "Doctor of Legal Sciences" at the Faculty of Law of the University of Tirana. In the years 2000-2006 she worked as an assistant commissioner/legal expert at the institution of the People's Advocate and in the years 2006-2007 she practiced the profession of lawyer. During the period 2007-2019, she worked as a legal advisor at the Constitutional Court.

Since 2005, she has been a lecturer of Administrative and Constitutional Law at various universities, as well as a human rights trainer at home and abroad. Since 2010, she has been involved as an external legal consultant in a number of projects of international organizations, related to human rights and the judiciary. Elsa Toska has been part of the experts in 3 working groups during the Justice Reform, namely for Constitutional Amendments, Changes in the Law on the Constitutional Court and the drafting of the draft law for the President of the Republic.

She is the author of several scientific publications in the form of manuals or monographs, where the monograph "On constitutional control of administrative activity, according to the jurisprudence of the Constitutional Court" can be singled out, as well as co-author of the book "Control over public administration", 2013, approved academic text from the Department of Public Law, Faculty of Law, Tirana. Since 2017, she has been an expert in continuing education at the School of Magistracy. Toska is the author of several scientific articles and a participant in several scientific conferences inside and outside the country on issues of constitutional justice. In November 2019, she was appointed a member of the Constitutional Court.
