What are the experts that the US-EU entrusted with the monitoring of the "Xhafaj" commission?
The United States of America and the European Union have moved to prevent the alienation of justice reform. The US Embassy confirmed Thursday's news that it has sent its experts to the "Xhafaj" commission. The mission of the European Union has also done the same.
This move comes at a time when Berisha has given signals that he will send his deputies to this commission, which is seen as a danger for SPAK and other justice or independent bodies, such as KLSH or ILDKP. The American Embassy itself yesterday made it clear to both Rama and Berisha that the reform is not affected. Two ladies will guarantee this: Mary Kate Butterfield and Agnes Bernhard .
The first will represent the USA. Mary Kate Butterfield is currently OPDAT's Chief of Mission. She has served in the US as a deputy prosecutor and has followed many investigative cases. She has been in Tirana for a year and leads the group of US legal experts. So she is well-informed on Albanian legislation.
The second name is quite familiar. Agnes Bernhard is one of the people who knows the justice reform "intensely". She is one of the architects of the legal changes. Agnes Bernhard was part of the senior experts who drafted the reform and led the EURALIUS mission, the main mission in the drafting of all laws. So she knows every change very well, since she has designed a large part of them herself. Agnes Bernhard is a very big guarantee in the "Xhafaj" commission, as she can "smell" even the secret maneuvers that can be done with certain laws.
In addition, the career speaks for itself. During nearly 30 years of professional experience, Bernhard has gained extensive experience in judicial activity as a member of the Austrian Administrative Court of Appeal, the Austrian Constitutional Court and defending Austrian cases before the European Court of Justice. In addition, it has continuously provided training for judges, prosecutors and civil service employees and has implemented a wide range of technical assistance projects, among others for the Albanian School of Magistrates, the Supreme Court of Cassation and Justice in Romania and for the Prosecution and Judiciary Councils in Kosovo.
She has conducted more than 30 studies, under the auspices of the European Commission, in particular in the areas of access to justice, efficiency of legal remedies, environmental criminal justice and anti-discrimination law.
The signals are that Rama and Berisha may try to approve legal changes or impose restrictions on the justice bodies, a move to curb the progress of the reform and escape arrest. But yesterday the USA gave the message and the guarantee will be the two ladies in question, as long as the US ambassador has not arrived yet. / Pamphlet
