Today, at 10:00 AM, the Constitutional Court will consider the lawsuit of deputies from the group of Gazment Bardhi and Sali Berisha regarding the agreement with Italy for immigrants.
The Constitutional Court considered on December 13, the request made by 30 deputies of the Berisha-Bardhi group regarding the Italy-Albania agreement, which is considered by them to be anti-constitutional.
The consideration of the request by the Constitutional Court automatically brought the suspension of the ratification of the agreement in the Assembly, which was planned to be done in the plenary session of December 14. The Prime Minister, Edi Rama, did not prefer to give comments, saying that such a thing is within the right of the Constitutional Court.
On December 6, 2023, 30 democratic deputies submitted to the Constitutional Court the request to declare the agreement between Albania and Italy on immigrants, signed on November 6, 2023 in Rome by Prime Ministers Rama and Meloni, incompatible with the Constitution.
The Berisha-Bardhi grouping simultaneously requested from the court the prohibition, as well as the suspension of the procedures for the ratification of the protocol by the Assembly.
"Edi Rama cannot decide our fate in violation of human rights. This has nothing to do with our relationship with Italy, which will always be better," said the Bardhi-Berisha group.
But in their lawsuit, the deputies who support Berisha e Bardhin claimed that the agreement was negotiated and signed in the absence of authorization from the President of the Republic, which contradicts the Constitution, the Vienna Convention on the Law of Treaties and the jurisprudence of the Constitutional Court.
The draft agreement on migrants was approved by the Italian government on December 5 and sent to the Italian parliament for approval.
On November 6, 2023, Prime Minister Edi Rama and Italian Prime Minister Giorgia Meloni signed in Rome the agreement for the construction in Albania of two centers for housing immigrants.
According to the agreement, the landing port will be Shengjini, while Gjadri will be the camp where their accommodation will be built. The maximum host capacity is 3 thousand beds.
