
In order to expand the online civil status services in the process of digital transformation, the government proposes an amendment to the law "On civil status" where citizens are obliged to declare their place of residence and place of residence.
In the presentation of the draft, Minister Taulant Balla said that the initiative aims to encourage the declaration of residence, in the registration of compatriots who live outside the territory, those with refugee status or with a residence permit.
"First we need to complete the legal framework to enable the further transfer of GJC services online. The second concerns the clarification of the definition of residence and place of residence in order to harmonize them also according to the Civil Code. Thirdly, it has to do with a problem that you have also encountered in relations with voters, which has to do with both registers and demographic data.
Treatment of cases where children are stillborn, with the aim of accurate reflection, both in the registers and in the demographic calculation. The fourth has to do with addressing the phenomenon of fictitious marriages, which mainly refer to the use of legal artifice, taking the spouse's last name and claiming to have taken an identity to escape certain restrictions. We are also dealing with some additional measures for not declaring the place of residence and residence, let's not forget that these are necessary data for the citizen, where according to the principles of the Civil Code and not only, the citizen has this type of obligation to declare it, since through her receives services. In the 2009 law, citizens have an obligation to declare the residence where they live, while in the new law, the obligation to declare the address of residence and place of residence, as well as their change, is foreseen. For the opposition, the draft creates demographic distortions for electoral reasons.
"Ask to manipulate elections where you have fewer voters to make electoral distortions. Why is it necessary to register compatriots to vote, if they have to vote, a list is made in the CEC and they register themselves.. why do you have to make a portal to register... these are things to take measures to get the elections on the table.. making demographic deformations" , said Çupi.
"They have nothing to do with the upcoming parliamentary elections" , added Balla.
The Laws Committee will vote on the draft together with the recommendations at another meeting. Minister Balla pointed out that since May 1, 2022, when the civil status office offered online services, 11.5 million certificates have been issued, saving Albanians about 13 million euros in costs and physical time to go to the civil status office.
