The second lawsuit against the changes in the Electoral Code was submitted to the Constitutional Court, according to which the list of candidates for deputies is closed in 1/3 and 2/3 open.

Representatives of the parties Adriatik Lapaj's Albania Becomes and Endri Shabani's Nisma Thurje filed a lawsuit in the Constitutional Court today, while accusing that the changes were reached after a pact between Edi Rama and Sali Berisha, who seek to return the 2008 system.

Shabani emphasized that the approved changes take away the right of Albanians to vote for the candidate and the preferred alternative, since they impose representatives who may be undesirable for the voter on the closed list. On the other hand, Shabani said that Berisha and Rama think that only they both have the right to choose the deputies and not the Albanians.

"Edi Rama and Sali Berisha think that only they both have the right to elect deputies, we think that this is the right of Albanians, through open lists. They cannot force us to enter the elections with closed lists. In 2021, Albanians exercised their right to vote their preference. They want to take away this right. We think that the constitutional will abolish these changes, it is a battle for the Constitution of Albania. They teamed up again, just like in 2008 to bring back the 2008 system.

We are addressing these changes to the Constitutional Court, to abolish them for several reasons, but basically, who has the power to elect deputies. Rama and Berisha think that they both have this right. We believe that this is the constitutional right of Albanians. The second is the imposition they make not only on their own voters, but also on the voters of Nisma Thurje or Albania Becomes. They force every subject to enter with closed lists. We believe that the Constitutional Court will abolish these changes", said Shabani.

We remember that two weeks ago Enkelejd Alibeaj and Dashamir Shehi also sent the new electoral changes to the Constitutional Court. Meanwhile, today, their legal representative, Rezart Kthupi, addressed a request to the Constitutional Court, through which he requests that their lawsuit against the closed lists be examined with priority.

The majority and the opposition reached an agreement on the lists of candidates for deputies for the 2025 elections. After a marathon session, the Assembly approved on July 26 with 106 votes in favor, 2 against and no abstentions, the new changes to the Electoral Code which provides that the list of deputies will not be completely open. 1/3 will be closed and exclusive to the party chairman and not subject to preferential voting.

While the candidates in 2/3 of the list will fight to win even one vote more than the others. For the first time, Albanians living abroad are expected to vote in the 2025 parliamentary elections.
