
Nearly five years after the death of Diego Armando Maradona, the legal process related to his death is still ongoing. The new Argentine court, tasked with judging the facts that occurred in November 2020, rejected on Wednesday the request to disqualify two judges, presented by the defense of Maradona's personal doctor, Leopoldo Luke.
According to the defense lawyers, the judges in question would not be impartial, raising suspicions of “well-founded fear of bias.” However, the court rejected this request, describing it as “a mere initiative to delay the process, based on personal opinions, conjectures and assumptions without any legal basis.” The defense has announced that it will appeal the decision.
Luke is one of seven healthcare workers facing charges, including doctors, nurses, a psychiatrist and a psychologist, accused of “intentional homicide.” Essentially, they are accused of negligence, despite being aware of the risk to the patient’s life.
The expected sentences range from 8 to 25 years in prison. The first trial was canceled at the end of May, after more than two months of hearings and over 40 witnesses heard, due to a scandal that erupted. This scandal was related to the judge's involvement in the production of a documentary about the trial itself.
Maradona died on November 25, 2020, at the age of 60, as a result of cardiac arrest and pulmonary edema, after hours of agony, at his residence in Tigre, where he was recovering from neurosurgical intervention.
