Rubiale's kiss on the lips with the World Champion, the Spanish Court makes

In a recent ruling, Spain's highest court, which deals with matters related to sports law, ruled on Friday that Football Federation president Luis Rubiales' forced kiss with striker Jenny Hermoso did not constitute a "very heavy" of Spanish law.

By opening an investigation into Rubiales only for a "serious" breach, as opposed to a more serious breach of the country's sports law, the Administrative Court for Sport made it impossible for the autonomous government agency that oversees all sporting activities in Spain to suspend the head of the federation until a final decision is issued.

Secretary of State for Sport Victor Francos, who chairs the High Council for Sport, told Spanish media that the body will ask the court to temporarily suspend Rubiales.

The court's decision is a serious blow to Spain's left-wing coalition interim government. During the week, Deputy Prime Minister Teresa Ribera, Equality Minister Iren Montero and Culture and Sports Minister Mikel Iketa pledged that Madrid would take steps to ensure Rubiales got the boot as soon as possible.

For now, only the 90-day suspension imposed by FIFA's disciplinary committee, soccer's global governing body, prevents Rubiales from leading the Football Association. If FIFA decides to take no further action, the Spaniard could theoretically resume his position at the end of November.

But the country's administrative mechanisms have proven ineffective and the national football federation is unwilling to take action on its own. Rather than censure and sack Rubiales, regional federation presidents earlier this week opted to call for the FA chief's resignation, days after he defiantly declared he was going nowhere.

Similar efforts to oust Horge Vilda, the head coach of the country's women's national team, who was seen cheering for Rubiales during a fiery speech in which he criticized "faking feminism," have also gone nowhere.

Although the women's World Cup winning team announced that they will not play under him and all of his technical staff have resigned, the coach officially remains in the post.

Luis de la Fuente, head coach of Spain's men's national soccer team, on Friday similarly refused to resign from his post despite public anger over the standing ovation he gave Rubiales after his rant against political correctness .

However, the coach apologized for his "unforgivable" applause, which he said deserved criticism.

"Anyone who knows me knows that these gestures do not represent my values, nor my way of thinking or acting in life," said de la Fuente. "I have always been on the side of equality and respect."
