A Swiss court has acquitted former Australian racing driver Joey Mawson of rape charges brought by a nurse who worked in the care team for Formula 1 legend Michael Schumacher.
Mauson, 30, was accused of sexually assaulting the nurse during a party held in 2019 at the Schumaker family residence in Gland, near Geneva. According to the woman's claims, she was raped twice after she passed out from alcohol consumption.
Throughout the trial, Mauson denied the charges, insisting that the relationship had been consensual. After reviewing the evidence and testimony, the court decided to acquit him of all charges, reasoning that it was not possible to prove his guilt beyond a reasonable doubt.
" It's the right decision; he can finally make plans for the future now that his name has been cleared ," said Mawson's lawyer, Luc Vanney.
On the other hand, the nurse reacted with disappointment to the verdict and left the courtroom in tears. In a public statement, she said she felt abandoned by the justice system.
" I've been through hell for the last six years. First I was attacked, then I lost my job, and now the court has basically said I'm a liar ," she said.
What was said in court?
According to court documents, Mauson was playing pool with two members of the Shumaker family's staff on the night of the incident when the nurse joined the group after finishing her shift. The woman had consumed alcohol and then felt unwell. She initially slept on the floor, but was later taken to a bedroom by her colleagues.
The prosecution alleged that Mauson later entered the room and had sex with her while she was unconscious. However, the court concluded that the allegations could not be proven to the standard required for a criminal conviction.
Mauson himself testified that he had stayed in her room until the early hours of the morning and that he had believed that she was in a better state than she later turned out to be. He also admitted that he had consumed a lot of alcohol and did not accurately remember all the events of that night.
The case was reported years later.
The case came to light several years after the alleged incident. The nurse left the medical team caring for Michael Schumacher in 2020, while the criminal complaint was filed in 2022.
The Shumaker family was not a party to the proceedings and did not face any charges or allegations of legal wrongdoing.
Also presented during the trial were messages that Mawson had sent to the nurse after the incident, in which he apologized for any pain or distress he may have caused her.

Joey Mawson was considered one of the most promising talents in Australian motorsport. He was a friend and rival of Mick Schumacher, son of seven-time Formula One world champion Michael Schumacher, and raced alongside renowned drivers such as Lando Norris and George Russell.
However, his sporting career faced difficulties after being involved in a doping case, which led to his suspension from competitions.
