Links to criminal groups in Saranda, SPAK sends three former police officers for trial; names

The defendants, Erdit Hazizaj, Shkëlzen Ruska and Ervis Alisinaj, during 2020, in violation of their legal and functional obligations as employees of the State Police, committed actions and omissions that seriously violated the regular functioning of police structures, by failing to take measures to prevent and crack down on criminal activities in the cultivation and trafficking of narcotics or other illegal actions.

SPAK has sent three former police officers to trial for links to structured criminal groups in the trafficking and cultivation of narcotics.

The Special Prosecution Office against Corruption and Organized Crime completed the investigations and has sent to the Special Court of First Instance the request for the trial of criminal proceedings no. 169/1 of 2022, against the defendants: 

Erdit Hazizaj, accused of committing criminal offenses:

"Drug trafficking", carried out in a special form of cooperation, that of a structured criminal group, provided for by articles 283/a, first paragraph, and 28/4 of the Criminal Code;

“Structured criminal group”, committed in the form of participation in a structured criminal group, provided for by Article 333/a, second paragraph, of the Criminal Code;

“Commitment of criminal offenses by a criminal organization and a structured criminal group”, provided for by Article 334, point 1 of the Criminal Code;

"Abuse of office", provided for by Article 248 of the Criminal Code.

Shkëlzen Ruska , accused of the following criminal offenses:

"Cultivation of narcotic plants", carried out in a special form of cooperation, that of a structured criminal group, provided for by articles 284, first paragraph, and 28/4 of the Criminal Code;

“Structured criminal group”, committed in the form of participation in a structured criminal group, provided for by Article 333/a, second paragraph, of the Criminal Code;

“Commitment of criminal offenses by a criminal organization and a structured criminal group”, provided for by Article 334, point 1 of the Criminal Code;

"Abuse of office", provided for by Article 248 of the Criminal Code.

Defendant  Ervis Alisinanaj, accused of committing the criminal offense:

"Abuse of office", provided for by Article 248 of the Criminal Code.

This criminal proceeding has been separated from criminal case no. 169 of 2022.

The investigations conducted show that during the years 2019-2021, a structured criminal group involved in the cultivation and trafficking of narcotic plants operated in the Saranda area. The leader and organizers of this group are suspected to be the citizens under investigation, KQ (alias JH, alias JQ) and EA (alias KA). The members of this group had defined tasks for the provision, transport and trafficking of narcotics from Albania to Greece.

Investigations have documented the case of trafficking, on 7.3.2020 through the Qafë Botë border crossing point, of a quantity of 1144.9 kg of raw cannabis sativa, 4.068 kg of processed cannabis (chocolate) and 0.916 kg of processed cannabis (oil), worth approximately 1.7 million euros. This quantity was seized from two Italian citizens convicted in Greece.

When members of the group were arrested by law enforcement agencies, other members were interested in providing economic assistance to the arrested persons and providing protection in court proceedings. According to the investigations, members of this structured criminal group had established contacts and social ties with State Police employees, in order to enable the continuation of criminal activity.

Such is the case of Erdi Hazizaj, at that time he held the position of specialist in the Covert Investigation Sector, in the Directorate of the Special Operational Force, who assisted the leaders of the structured criminal group with advice and continuous information on the development of illegal activity.

During the years 2019-2021, in the Tepelenë-Gjirokastër area, a structured criminal group, involved in the cultivation of narcotic plants, operated under the leadership of the citizen under investigation, LB (alias ES), while the members of the group had separate tasks for the cultivation of narcotic plants in the Tepelenë - Gjirokastër area. The investigations have documented the case of 1.10.2020, on the road between the village of Dukaj and the village of Salari (Tepelena), where the Gjirokastër Local Police Directorate discovered and seized 1360 narcotic plants, 30-120 cm long, in a wet state, with a total weight of 1280 kg. The quantity of narcotic plants was cultivated by this criminal group.

Its leader had also established contacts and social ties with employees of the State Police, in this case, with the defendant Shkëlzen Ruska, who at that time held the position of specialist in the Gjirokastra Local Police Directorate. He is suspected of having assisted the leader of the structured criminal group by providing information and guarantees for the illegal activity.

From the totality of the evidence administered, it results that the defendants, Erdit Hazizaj, Shkëlzen Ruska and Ervis Alisinaj, continuously, during 2020, in violation of legal and functional obligations, as employees of the State Police, have committed actions and omissions that have seriously violated the regular functioning of police structures, by failing to take measures to prevent and crack down on criminal activities in the cultivation and trafficking of narcotics or other illegal actions.

These actions, based on the investigations conducted, have brought serious consequences for the legitimate interests of the state and have undermined the credibility of the State Police before the public and have harmed the exercise of its mission in guaranteeing public order and security, in accordance with the Constitution and the law.
