The lawyer Kreshnik Spahiu, analyzing the recent actions of SPAK regarding the 'Partizani' case, stated that there were procedural errors in the file.

In an interview for the "Review" show on "Euronews Albania", he said that the measure against former Prime Minister Berisha is deprivation of liberty, which is in violation of the constitution, given that Berisha is a member of Parliament.

" Are there procedural problems? No doubt there is. Article 288 of the criminal procedure code provides that for subjects who have the mandate of a member of parliament and for whom the measure of prison arrest, house arrest, or any other type of deprivation of liberty is required, including house control, or personal control , authorization must be obtained from Parliament.

Is the obligation to appear, not to leave the country and obtain a passport a restriction of freedom, yes it is. Is it a restrictive measure, yes it is.
