The Court of Appeal in Tirana has refused the extradition of Dritan Goxhaj to The Hague and at the same time decided to release him from the cell.
Judge Gent Shala made a dignified decision by refusing extradition and ordered Goxhaj's immediate release.
Lawyer Ardjan Visha appealed the decision of the Court of Tirana, which accepted the extradition. Goxhaj himself was also present at today's session.
"At the end of the appeal trial, today on 10.10.2023, the Court of Appeal of General Jurisdiction, composed of the panel with Judge Mr. Genti Shala, decided:
- The change of decision No. 1204 Act, dated 19.09.2023, of the Court of First Instance of the General Jurisdiction of Tirana.
- Cancellation of the request for the extradition of the citizen DG from the Republic of Albania to the Republic of Kosovo.
- Removal of the security measure "arrest in prison", for the DG citizen, determined by decision No. 1123 Act, dated 20.07.2023 of the Court of First Instance of the General Jurisdiction of Tirana.
- The release of citizen Dritan Goxhaj is ordered, if he is not held for any other criminal offense," the Appeal of Tirana announces.
When was Dritan Goxhaj arrested?
Goxhaj was arrested in our country on July 31 by order of the Special Court for War Crimes.
The associate of the Kosovo Liberation Army has repeatedly opposed the accusation by calling on the Albanian authorities not to allow his extradition.
Former member of the Kosovo Liberation Army, Dritan Goxhaj is accused of criminal offenses against the administration of justice that include intimidation and obstruction of official persons in the performance of their official duties. For more than a month and a half, Goxhaj opposed the extradition and described the arrest as an illegal deprivation of liberty.
Dritan Goxhaj was arrested on July 31, 2023 with an arrest warrant issued by the Special Court of Kosovo for the purpose of extradition to The Hague. The Special Court of Kosovo has issued an arrest warrant for the escort of the American troops during the War in Kosovo in 1999, after accusing him of revealing the names of witnesses in several cases previously opened by the Special Prosecutor's Office of Kosovo.
But why was Dritan Goxhaj arrested?
In an announcement of the Special Court, it is said that Goxhaj's arrest was made today, while it is related to a criminal offense against the administration of justice that includes intimidation and obstruction of official persons in the performance of their official duties.
"On July 31, 2023, the Albanian authorities arrested Mr. Dritan Goxhaj in Tirana. The DHSK requested the cooperation and assistance of the Albanian authorities for the arrest of Mr. Goxhaj and his delivery to the DHSK, on the basis of the arrest warrant issued by a judge of the DHSK in relation to criminal offenses against the administration of justice that include intimidation and obstruction of official persons in the performance of their official duties. Mr. Goxhaj will be detained in Albania pending the decision of the Albanian authorities regarding the transfer of Mr. Goxhaj in the DHSK detention facility in The Hague".
