The 15-year-old who shot dead his peer six times a few meters from the Fan Noli school can be sentenced to a maximum of 17 years in prison, if the charges against him are not requalified by the prosecution.

"When a minor between the ages of 14 and 18 commits a crime, the first is exempted from life imprisonment and the second receives half of the maximum sentence, which is 17 years of imprisonment," said lawyer Arbër Hoxha.  

"If he was an adult, he would go beyond life imprisonment. The sanction must be severe, not only for the specific case, as serious events will occur. It can happen to us en masse, it is a phenomenon that must be tackled. It's terrible to lose a child, I have no words. Here human life has become worthless. When a 14-year-old child runs away with a cutting tool, it is shocking and alarming," said lawyer Saimir Vishaj.

The lawyer explains how the Penal Code works for minors who are perpetrators of crimes.

"The Penal Code stipulates that the age for criminal responsibility is 16 years for criminal misdemeanors and 14 years for crimes. It is important that on the day the criminal offense was committed, the person must have turned 14, that is, 14 years and one day. At the moment he is under 14 years old, he does not bear criminal responsibility, but according to criminal justice for minors, despite the fact that he does not bear criminal responsibility, he will be taken to a rehabilitation institute", said lawyer Hoxha.

However, the two jurists, Saimir Vishaj and Arbër Hoxha, do not agree on lowering the age limit for the punishment of minors.

"Changes are needed in the criminal code. If we look at Greece from a theoretical criminal point of view, the age has been lowered. If we are 14 years old, the age for criminal responsibility is 12 years old, because time has evolved, currently 12, 13 or 14 year olds have a different mind, 10 years or whole years, from one generation to another, time evolves", said lawyer Vishaj.

"No, the age threshold should not be lowered, this is a 300-year-old institute, it is an institute that the entire Romano-Germanic system knows. But a more persuasive work must be done and criminal policies should not be so harsh, because criminal policies do not necessarily lead to a reduction in criminality," said lawyer Hoxha.

If the perpetrator of the crime, Mario Përleshi, if the court decides to arrest him in prison, then he will go to the Juvenile Institute in Kavaja, in the detention section until he is informed of the final decision.
