The Shkodra Prosecutor's Office launched a property investigation against Sonjela Gjolaj, Ago Imer Gjolaj and their family members within the framework of the law "On preventing and combating organized crime, trafficking and corruption through preventive measures against property", also known as the "Antimafia law". .

Sonjela Gjolaj, a businesswoman in Shkodër, bought a yacht in Montenegro in 2018. The seller was Sasa Jakica, a Montenegrin citizen involved in criminal activity and money laundering, according to Podgorica officials.

This detail was the starting point for the property investigation against Sonjela Gjolaj and her husband, Ago Imer Gjolaj, who are known as the distributors of the energy drink "8S2", a product similar to the original product "B52".

In a few weeks of investigations, where other members of the Gjolaj family were also involved, the Shkodra Prosecutor's Office raised doubts that they do not justify the wealth created with legal sources. Under these doubts and after a detailed financial analysis, the Prosecutor's Office obtained the court's permission to seize their assets.

The company "BM" shpk, a business facility with an area of 2592 m2, 97 vehicles of the company, as well as the amount of money in the accounts of Sonjela Gjolaj, Ago Imer Gjolaj and the commercial entity were placed under seizure.

The company, in a statement published in some media, rejected the arguments of the Prosecutor's Office, considering it as a "media attack" to hit the business, despite the fact that the investigation and seizure was decided by the court.

Details of the investigation

In September 2014, Ago Imer Gjolaj and Sonjela Gjolaj applied for a legalization permit for a "Social-Economic Building" object with a total area of 2592 m2, in Koplik.

According to the self-declaration of the applicants, they built this building at the beginning of 2014. Further, the Gjolaj spouses decide to give up the application for legalization, passing it in favor of their commercial company, 'BM" shpk.

In December 2016, the company received the legalization permit and registered the object in the Malësi e Madhe Mortgage.

As part of the investigation, the prosecutor of the case, Blerta Hamza, has ordered the performance of a financial expertise to identify the cost of this building and the financial possibility of the Gjolaj spouses.

Referring to the Instruction of the Council of Ministers for the average construction costs in 2014, when the facility was built, in the Shkodra area, it was determined at 39,803 ALL per m2.

The prosecution, taking into consideration the fact that Gjolaj's building was without a permit, that is, without paying taxes, has reduced the construction cost to the amount of 26,515 ALL per square meter.

Based on this mathematical analysis, the value of the 2-story building was calculated at a total of 68,726,880 new ALL.

For this figure, the Prosecutor's Office has reached the conclusion that Sonjela and Ago Imer Gjolaj did not have financial opportunities.

Based on the financial analysis, the profits of the company for 4 years are in the amount of 22,174,334 ALL, an amount at least 3 times lower than what was used for the construction of the 2-story building with an area of 2592 m2.

In support of this financial analysis, the Prosecutor's Office has established that Ago Gjolaj and Sonjela Gjolaj have not had legal income over the years for the construction of this social-economic building.

The Gjolaj family members were considered as subjects of this law since, according to the Shkodra Prosecutor's Office, there are sufficient indications to create the suspicion that they are involved in illegal activities and with their actions have consumed the elements of the criminal offense "Cleaning the products of criminal offense or criminal activity".

The prosecution has established the belief that the assets of Ago and Sonjela Gjolaj derive from the illegal activity of the citizen Ago Gjolaj and believes that there is a real risk of their alienation by passing them on to third parties.

For these reasons, the prosecution turned to the court for the sequestration of the assets of the Gjolaj spouses, a request which was accepted by a court decision on April 16, 2024. / Bold News
