The full draft of the criminal amnesty has been released. Although it was trumpeted with great fanfare that the amnesty would be for the end-of-year holidays, the government plans to pass it now.
According to the draft, approximately 10,000 people are expected to benefit, including approximately 380 convicts who are expected to be immediately released from prison and approximately 980 others who will benefit from a reduction in their sentences.
According to the draft, the amnesty will benefit men who have been sentenced by a final decision by December 31, 2025 and who have a sentence of up to 3 years in prison, as well as women sentenced to up to 4 years in prison. Immediate release is also foreseen for those who, at the time of the law's entry into force, will have to serve up to 3 years in prison for men and up to 4 years for women, regardless of the initial sentence.
The draft also includes the release of all women over 50 years old and men over 60 years old, as well as convicts who were 18 years old or younger at the time of committing the criminal offense, always with the exception of criminal offenses that are foreseen as not included in the amnesty.
Who is released immediately?
According to the draft law, the following will benefit from immediate release:
-men sentenced to 3 years or less;
-women sentenced to 4 years or less;
-men who have up to 3 years left in prison to serve;
-women who have up to 4 years left in prison;
-men over 60 years old and women over 50 years old;
-all convicted persons who were 18 years of age or younger at the time of the commission of the criminal offense.
-Reduction of sentences for about 1 thousand prisoners;
In addition to immediate releases, the draft also provides for a reduction in sentences for around 1,000 people. Specifically, the sentence will be reduced by 1 year for men and by 1.5 years for women and minors.
Excluded from these benefits are those convicted by the Criminal Code, those sentenced to life imprisonment, persons who have evaded justice, as well as perpetrators of serious criminal offenses, including murder in qualifying circumstances, the murder of public officials, the murder of police officers, and domestic murder.
Suspension of criminal prosecution for around 9 thousand people
Another important effect of the criminal amnesty is related to the cessation of criminal prosecution for about 9 thousand citizens. The draft provides for the termination of ongoing investigations and trials, as well as cases not yet registered, for criminal offenses committed until December 31, 2025, for which the Criminal Code and the Military Criminal Code provide for a sentence of up to 3 years in prison.
Even in this case, acts that fall into the prohibited categories provided for by the law are excluded. The law emphasizes that SPAK subjects do not benefit, but this was also stated in the previous amnesty and in fact nearly 100 people benefited. / Pamphlet
