Election crimes of May 11, SPAK makes the first "strike"; sends two

The investigations have revealed that the actions committed constitute the elements of the criminal offenses of active and passive corruption in elections.

The Special Prosecution Office Against Corruption and Organized Crime, SPAK, has sent for investigation one of the first corruption-related cases in the May 11, 2025 elections. SPAK is reported to have completed the investigations and sent Pandeli Bozha and Vladimir Lushkaj for trial, after Bozha is accused of buying votes for the daughter of the Social Democratic Party, PSD, candidate in the Fier District. 

The investigation results in the documented episode that occurred on May 8, 2025, at around 10:00, when Pandeli Bozha visited Vladimir Lushkaj's apartment. According to the evidence, Bozha put a banknote in Lushkaj's pocket and showed him a ballot paper similar to the one on the ballot paper, where the name of a candidate for deputy was highlighted in orange, suggesting who to vote for. After questioning, Lushkaj handed over the banknote and ballot paper in question to the judicial police, which were seized as evidence. The investigation results in the actions committed constituting the elements of the criminal offenses of active and passive corruption in elections.

" SPAK completes investigations and sends the case to court for corruption in elections. The Special Prosecution Office against Corruption and Organized Crime completed the investigations and sent to the Special Court the request for trial of criminal proceedings no. 60/1 of 2025, against the defendants: Pandeli Bozha – accused of the criminal offense of "Active corruption in elections", provided for by articles 328 of the Criminal Code Vladimir Lushkaj – accused of the criminal offense of "Passive corruption in elections", provided for by article 328/bi of the Criminal Code.

The investigations for this criminal proceeding were conducted through proactive methods. During the investigative process, from the examination of the video footage and the procedural actions authorized by the prosecutor, an episode was documented on 08.05.2025, at around 10:00, when citizen Pandeli Bozha went to the apartment of citizen Vladimir Lushkaj. During this meeting, Pandeli Bozha put a banknote in his pocket and showed him a ballot paper similar to the one on the ballot, suggesting the name of the candidate for whom he should vote.

After questioning, citizen Vladimir Lushkaj handed over to the judicial police officers the banknote and a ballot paper similar to the one on which the name of the candidate for deputy was highlighted in orange. These materials have been seized as evidence in the framework of this criminal proceeding. From the entirety of the investigative actions, it has resulted that the documented actions fulfill elements of the criminal offenses of "Active corruption in elections" and "Passive corruption in elections", provided for respectively by articles 328 and 328/b of the Criminal Code ", SPAK's announcement states.

We recall that the head of SPAK, Altin Dumani, declared two days ago that 192 cases of suspected electoral crimes have been identified. He added that 43 criminal proceedings have been registered, which have entered the active investigation phase, while for 43 other cases it has been decided not to initiate criminal proceedings. Dumani also emphasized that 40 indictment materials have been sent for jurisdiction to the district prosecutor's offices, while 17 others have been merged with existing proceedings.
