The former head of the Prosecution of Serious Crimes, Eugen Beci, offered an in-depth assessment of the execution of criminal decisions and the role of the prosecution in judicial processes, singling out cases involving important figures of Albanian politics. He explained that the determination of the security measure by the court, especially in the case of the special court, and the control over its implementation are the exclusive powers of the prosecutor. This supervision starts from the moment the security measure is assigned until the end of the sentence, to ensure that the process is orderly and in accordance with the law.
Beci underlined that it is essential for the prosecution to exercise increased control over the form of arrest, stressing the importance of respecting the procedures defined in the criminal procedure code.
For him, the form of arrest has a critical role, because the supervision of the execution of criminal decisions remains the exclusivity of the prosecutor based on Albanian law. Relying on the experience and practices followed by the prosecution and the Albanian police, Beci explained that, after the appointment of a security measure in the absence, the close monitoring of the suspect begins, through the interception of telephone calls and the authorization for close physical observation, with the aim avoiding a possible escape and executing the arrest process efficiently.
" Criminal decisions, where in the specific case and the appointment of a security measure by a special court for a subject, are controlled in their execution by the prosecutor, from the moment of the appointment of the security measure until the end of the sentence.
These court decisions, in their execution, are always under the control of the prosecutor according to the special law and the criminal procedure code.
There should be another check by the prosecution regarding the form of arrest. The form is important in the execution of criminal decisions, because their supervision is exclusive to the prosecutor according to the law in force in Albania.
The method of arrest, taking into account the practice followed by the Albanian prosecutor's office and the police, is related to the fact that for a person to whom a security measure has been assigned, after the security measure has been issued in absentia, surveillance begins, not only through telephones, but also with the authorization for close physical observation of the person, in order that he does not evade the execution of the arrest process.
The appropriate time and place must be found, according to police manuals, to avoid collateral damage, both to police officers and to citizens who may be in the area.
In short, the judicial police, which is engaged in the execution of the security measure, even more so when it comes to a former president of the Republic, must show increased caution. At a minimum, it should implement standard protocols, which include the presence of police officers in uniform, vehicles identified with relevant logos, and police support vehicles, in case the operation is carried out in a public area, where assistance from the traffic police is necessary.
For this reason, all these aspects must be the subject of an investigation that the special prosecution must carry out in relation to the execution of the decision ordered by it.
If we go back to the year 2000, where there was no question of arrest, but of the escorting of former president Sali Berisha, even then, despite the hatred that existed on the part of the police of the time, no act of violence was recorded.
The special forces went with logged vehicles, surrounded the vehicle where the former president Berisha and another PD deputy were. They refused to get out of the vehicle and were escorted to the Police Department. Neither Berisha nor the other deputy were forced to get out of the car.
This tells us that whenever people associated with the opposition are arrested, there is always a camera and a media show is always created. Meanwhile, we don't see the same thing about the arrests or investigations related to the characters of the majority ", said Beci.
