The Special Board of Appeal announced on Thursday the opening of investigations against the prosecutor of Gjirokastra, Julian Çafka, and announced that he would administer the criminal files for which he has been denounced.
Also, the body of the College headed by Ina Rama, with rapporteur Natasha Mulaj and members Rezarta Schuetz, Albana Shtylla and Sokol Çomo, announced the receipt of 4 new denunciations and invited the parties to express themselves about them in the next session.
Before these interim decisions, KPA heard the submissions of Public Commissioner Florian Ballhysa and prosecutor Julian Çafka.
Prosecutor Julian Çafka was confirmed in office by the Independent Qualification Commission on September 14 after several cases denounced by the public, where deficiencies were found in the investigations carried out by the commanding head of the Gjirokastra Prosecutor's Office, as well as the suspicions raised by the Security Directorate. of Classified Information, DSIK for corrupt actions, were not considered penal.
Meanwhile, the KPK decided to transfer to the High Inspector of Justice two cases investigated by prosecutor Çafka in 2018 and 2019, for "inspection of causes that may constitute disciplinary violations".
In his speech, Ballhysa noted that he stood by the complaint and requested, among other things, that the KPA investigate the issues for which Çafka had been denounced and reevaluate him in terms of the criterion of professionalism. According to him, even the findings of the KPK on the issues for which Çafka was denounced should have brought a different result in its final assessment.
"The Public Commissioner estimates that the Commission's own findings on the above issues, depending on the results of the investigation requested through this appeal, would affect the final assessment of the subject of the reassessment," said Ballhysa in submissions.
He asked the KPA to consider the matters complained of and open an investigation. "We request that the reasons presented in this appeal be taken into consideration by the Special Appeals Board, ordering the opening of the investigation and the receipt of relevant evidence, according to the findings of the appeal and this submission", said Ballhysa.
For his part, Çafka asked the KPA not to consider the complaint and denunciations. He claimed that they were outside the scope of the reassessment institutions and exceeded the grounds of appeal.
Çafka contested the Commissioner's claims, referring mainly to the legislation on revaluation and claimed that the appeal was not valid.
In his speech, he referred to the decisions of the Constitutional Court, the recommendations for vetting by the Venice Commission and also the previous decisions taken by the College regarding the denunciations of this nature.
After listening to the parties, the KPA informed them about the new denunciations, asking them to express themselves about them at the next session on January 26, 2024. / BIRN
